TOWNSHIP OF MAHWAH

HOUSING COMMISSION MEETING

TUESDAY, DECEMBER 14, 2004

The meeting was called to order at 7:00 PM by Chairman Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Ridgewood News on October 29, 2004 stating the meeting would be held in room 311 in the Municipal Offices located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, December 14, 2004.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present: Commission members Martel (7:35), Plicinski, Raiz, Ross, Snyder.

Also present Nilufer DeScherer, Associate Township Atty.

Absent: Commission members Brotherton, Calandrillo.

Plicinski made the motion, seconded by Snyder, to approve the minutes of the November 9, 2004 Housing Commission meeting. All in favor. Motion carried. Raiz abstained.

Plicinski made a motion, seconded by Snyder, approving the minutes of the Closed Session of November 9, 2004. All in favor. Motion carried. Raiz abstained.

PUBLIC PORTION

On a motion by Snyder, seconded by Plicinski, the meeting was opened to the Public.

No Public in attendance.

Snyder moved to close the Public Portion, seconded by Plicinski. All in favor. Motion carried.

CORRESPONDENCE

Correspondence was reviewed.

HOUSING MANAGER’S REPORTS

All reports A through E-3 were reviewed.
UNFINISHED BUSINESS

a. Letters to owners-Re: Refinance, etc.-DeScherer-Tabled

b. 1168 Sycamore Ln.- DeScherer will send letter to owner

c. Status of Rentals-COAH-DeScherer spoke to Keith Henderson, COAH,
addressing the rental issue. He requested a letter to be sent to him, as well as, Lucy Voorhoeve, Executive Director of COAH.

NEW BUSINESS

a. 2010 Hawthorne Ln. –Reed reported on the matter which has developed between the owner and the Association due to non-payment of maintenance fees. The situation is compromising the well being of the tenant.

b. DeScherer reported she filed the request by Motion to COAH for the extension of Mahwah’s Substantive Certification on December 10, 2004. There is a twenty day public comment period now in effect. Mahwah is in full Compliance.

c. DeScherer discussed the letter received today from the Department of Community Affairs, regarding the Housing and Mortgage Finance Agency (HMFA) proposed amendments to the Uniform Housing Affordability Controls (UHAC) and the Council on Affordable Housing (COAH) re-proposed rules. The letter requested each municipality to review the draft rules to determine how these rules align with its’ affordable housing strategy. Mahwah does have some of the language in its’ Ordinance. DeScherer will do a detailed review of the draft rules.

d. DeScherer received a signed Stipulation from Ameriquest Mortgage Company agreeing to proceed with the Sheriff’s Sale on 389 Poet’s Way, subject to the Property remaining an affordable housing unit. The Sheriff’s Deed shall include specific language reciting applicable affordable housing restrictions, etc. The Commission will work with Ameriquest regarding Certified households eligible to purchase the unit at the Sheriff’s Sale.

CLOSED SESSION

At 7:15 PM Plicinski made a motion, seconded by Raiz, to enter into Closed Session for the purpose of discussing:

a. 389 Poet’s Way
b. 735 Pepperidge Ct.
c. 2010 Hawthorne Ln.

At 7:25 PM Plicinski made a motion, seconded by Raiz, to return to Open Session.
All in favor. Motion approved

DeScherer will draft a Resolution for the January Housing Commission meeting developing a procedure policy on any Affordable units going to Sheriff’s Sale.

Being no further business, Plicinski made the motion for adjournment at 7:40 PM. Seconded by Raiz. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Tuesday, January 18, 2005 at 7:00 PM. Ross wished everyone a happy, healthy holiday.
