TOWNSHIP OF MAHWAH
PUBLIC MEETING MINUTES
WEDNESDAY, NOVEMBER 10, 2004

The meeting was called to order at 8:03PM by Council President Richter who read the Open Public Meeting Act Statement as prescribed by law. Notice was advertised in The Record on July 6, 2004 and August 16, 2004 stating this meeting would be held on Wednesday, November 10, 2004 at 8:00PM in the Council Chambers at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag.

Roll Call Vote: Alderisio, yes; Calandrillo, yes; DiGiulio, yes; Kelly, yes; Paton, absent; Roth, yes; Richter, yes.

Also present were the Business Administrator Brian Campion, Township Attorney, Mayor Richard Martel, and Municipal Clerk Kathrine Coletta.

BILLS AND CLAIMS
On a motion by Calandrillo, seconded by Kelly, the Bills and Claims, previously signed, totaling $4,511,221.02 were approved. All in favor. Motion carried.

Richter also reintroduced 2 vouchers (#03-3243 and #04-3793) for Body Armor from General Ballistics totaling $4,533.96. On a motion by Calandrillo, seconded by Kelly, vouchers (#03-3243 and #04-3793) were approved. All in favor. Motion carried.

APPROVAL OF MEETING MINUTES
On a motion by DiGiulio, seconded by Calandrillo, the following Meeting Minutes were approved: the Work Session of February 19, 2004; Work Session of May 6, 2004; Public Meeting of July 15, 2004; Work Session of August 5, 2004; and Special Work Session of October 13, 2004. All in favor. Motion carried.

On a motion by DiGiulio, seconded by Calandrillo, the following minutes were approved: Public Meeting Minutes of June 24, 2004 were approved. Roll Call Vote: Alderisio, abstain; Calandrillo, abstain; DiGiulio, yes; Kelly, yes; Paton, absent; Roth, abstain; Richter, yes. Motion carried.

REPORT OF THE TOWNSHIP COUNCIL AND MUNICIPAL CLERK
Calandrillo thanked the Veterans who served in the past as well as those currently serving. Calandrillo stated our prayers are with them and she thanked them for their service.

Richter mentioned that tomorrow was the Veteran’s Service at Veteran’s Square at 10:30AM.

REPORT OF MAYOR AND BUSINESS ADMINISTRATOR
The Mayor stated that on Friday at 2PM Rockland Electric was dedicating their new Sub Station on Ridge Road at the Ramsey Border.

The Business Administrator stated there was a Preconstruction Meeting to demolish the Fardale Standpipe. The work should begin next week and be completed by the end of December.

MAYOR’S PROCLAMATION
Mayor Richard Martel made a proclamation naming Mahwah National Family Week as November 21, 2004 through November 27, 2004.

PUBLIC PORTION
On a motion by Calandrillo, second by Kelly, the meeting was open to the Public at 8:09PM. All in favor. Motion carried.

Mr. Allan Kidd of 111 Miller Road wished the Township Administrator a happy birthday.

Mr. Allan Kidd stated the lights at the Firehouse by Miller Road were adjusted to shut off during the day. Mr. Kidd stated that was a fantastic cost saving measure. Mr. Kidd was concerned, and asked the Business Administrator if the Firehouse was an Earthquake safe building much like the proposed Police Station. The Business Administrator stated he would look into it.

Mr. Allan Kidd stated Alderisio’s campaign pledge was to lower taxes. After discussing this with others, Mr. Kidd asserted many others were upset concerning Alderisio’s pledge and feel like they were tricked into voting for someone who has not lowered taxes by cutting the budget.

Mr. Allan Kidd asked for the Police Officer allegedly stationed in the Council Room to watch Mr. Kidd to be paid out of Council’s budget rather then the Police Department’s budget.

On a motion by Calandrillo, seconded by Roth, the meeting was closed to the public at 8:13PM. All in favor. Motion carried.

ORDINANCE - INTRODUCTION

AN ORDINANCE OF THE TOWNSHIP OF MAHWAH AUTHORIZING THE SALE OF LOT 26 IN BLOCK 3, A VACANT UNDERSIZED PARCEL OF LAND LOCATED ON STAG HILL ROAD PURSUANT TO THE LOCAL LANDS AND BUILDINGS LAW

RESOLUTION – ORDINANCE NO. 1503

Introduced by Calandrillo, seconded by Kelly.

RESOLVED that the Ordinance be passed and adopted on the first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be held on December 9, 2004 at 8:00PM in the Council Chambers at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey.

FURTHER RESOLVED that the Clerk shall publish said Ordinance with notice of introduction, passage and time and place where said Ordinance will be considered for final passage. Roll call vote: Alderisio, yes; Calandrillo, yes; DiGiulio, yes; Kelly, yes; Paton, absent; Roth, yes; Richter, yes.

On a motion by Kelly, seconded by DiGiulio, the following Ordinance was withdrawn.

RAFFLE APPLICATIONS
Raffle Applications for the Ramapo Ridge Middle School HSO (Off Premise) and the George Washington School (On Premise) were voted on separately and are attached to and made part of these Meeting Minutes.

COUNCIL COMMENTS AND COMMUNICATIONS
DiGiulio asked if Ridge Road would be paved being it was currently dug up. The Business Administrator stated there will be binder course placed over this area until repaving which will occur in the Spring.

Kelly distributed a Memorandum to Council, Mayor, Business Administrator and Township Engineer’s Office relative to a site visit on the Ramapo River Flood Control Project.

Kelly stated the Township may be able to qualify for money from the Army Engineers separate from the Ramapo River Flood Control Project for the Township’s Flood Control Studies and Work. Up to 65% of the Township’s costs may be covered which means the project may move a little faster.

Kelly stated December 1, 2004 the committee will have a meeting with Mr. Paul Tominello who was the person in charge of the Ramapo River Flood Control Project from the Army Engineers. Kelly stated once this meeting has taken place, he will have more news to report.

Richter thanked Kelly for all the work and meetings in conjunction with the Township Water Projects.

Calandrillo asked the Mayor if his Proclamations could be posted in the newspapers and asked if the newspaper reporters could push for publication. Calandrillo wished the Business Administrator a happy birthday.

Alderisio also thanked Kelly for all of his work on Township Water Projects.

Richter read and asked about a memorandum concerning Police Department related training on the Bulletin Board Cable Station for emergency messages. The Business Administrator stated this was a project he and Roth were working on in a related Sub Committee and it would not be happening for some time.

Roth stated he asked all on the Communications Sub-Committee to slow down on this. Roth wants the committee to have a meeting after Thanksgiving on policy and operational issues.

DiGiulio mentioned a wonderful article about Firefighters in the Record Newspaper. DiGiulio asked about qualifying for Grant Money from Homeland Security since the Township would be the first evacuation station from Indian Point. The Business Administrator stated he would look into this.

REPORTS OF SUBCOMMITTEES
DiGiulio stated her Sub-Committee would be meeting December 1, 2004. DiGiulio spoke to Mr. Keith Hallissey and the purchase order is in for the recycling bins. The Beautification Committee will begin selling them in December.

PUBLIC PORTION
On a motion by Calandrillo, seconded by Kelly, the meeting was open to the public at 8:36PM. All in favor. Motion carried.

Mr. Allan Kidd of 111 Miller Road pointed out that although he was in agreement with DiGiulio and applauded the Beautification Committee for their efforts. Mr. Kidd feels the Township local Ordinances are behind the times. Mr. Kidd pointed out holiday displays are illegal due to our outdated sign Ordinances, as well as the little green men “slow down” signs for children.

Mr. Allan Kidd stated Mr. John Lane had Scott Garrett, Wolfe, and Real Estate signs in his vehicle to destroy them. Mr. Kidd stated this was stealing from members of the public on the behalf of Mr. Lane.

Mr. Allan Kidd asked for Public Records he had requested to be given to him. The Township Attorney stated he would contact Mr. Kidd on Friday in regards to this matter.

Richter asked about the “little green men” caution children signs. Calandrillo stated she has seen them, and was aware of their existence.

On a motion by Calandrillo, seconded by Roth, the meeting was closed to the public at 8:41PM. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Alderisio, the meeting was adjourned at 8:42PM. All in favor. Motion carried.
