July 11, 2002 Minutes

The meeting was called to order at 7:30 p.m.

SUNSHINE STATEMENT: The secretary read the Sunshine Statement.

PUBLIC SESSION: None at this time. Mrs. Drago made a motion to close the Public Session and Mrs. Kennedy seconded the motion. The motion was approved with a vote of 6 yes, and 0 no. Public Session was closed at 7:40 p.m.

CHAIR’S REPORT:
*Township Attorney Representation: Mrs. Drago introduced Ms. Donna Tamayne an associate with Herten Berstein....Township Law Firm as the attorney representing the Mahwah Historic Preservation Commission (MHPC). Ms. Tamayne reported that she had met with Mrs. Drago on June 5 to review the policies and regulations of the MHPC and will assist the MHPC with applications and other matters concerning the MHPC.

*Conflict of Interest: Mrs. Drago reported that she contacted Township Attorney Mr. Toskos on June 14 (and prior to that) regarding conflicts of interest. His reply has been e-mailed to all members. Copies were made available at the meeting. Mrs. Drago asked that each member read the letter before the meeting ends.

*Beth Haverim Temple: Mrs. Drago reported that the MHPC received a letter from Elkin/Sobolta & Associates Architects in reply to Mrs. Drago’s letter regarding the restoration of the milk house at the Beth Haverim Temple. A copy of the correspondence is in this month’s MHPC packet. Mrs. Drago requested that Ms. Tamayne reply to the letter. Mrs. Drago expressed her concern that there is no time frame regarding the adaptive reuse of the structure. Mrs. Drago received a draft of the Planning Board resolution regarding the milk house and expressed concern that issues raised by the Commission were not included in the resolution. Ms. Tamayne will research the issue and prepare a statement regarding the items that were not addressed in the resolution concerning the mild house. Mrs. Drago will report on this at the August 8, 2002 meeting.

*Vista Bahn Estates: A copy of the recommendation for the Route 202 Recreational Facility as requested by the Commission is included in this month’s packet. Mrs. Drago met with the Mayor regarding matching grants for the Route 202 Recreation Facility project for an archaeological dig, and scoping of the property. Mrs. Drago reported that the Mayor and Council President John Spiech are interested and the Mayor told Mrs. Drago to pursue the project. Mrs. Drago has contacted three archaeological firms and has scheduled appointments with two of them to meet with the Mayor. Mrs. Drago also asked the Mayor if he could speak with Boswell McClave Engineering regarding the milk house drainage. The Mayor agreed to speak with Boswell. The Mayor also expressed disappointment that the Township Council decided not to allocate monies to save the Birch tree on the Route 202 property. Mrs. Drago asked if some of the bark could be given to Ramapo College for review and a slab of the tree to the sculpture department. Mrs. Drago also suggested to the Mayor that Township Council consider a sculpture of the Continental Soldiers at the continental Soldiers Park.

*Bergen County Office: Mrs. Drago researched and confirmed that all the pages in the Bergen County Historic Survey are accurate. Mrs. Drago had copies made for each member for their use. Each member will need to sign a statement that they have received a copy and will return their copy to the Commission files upon their resignation from the Commission. The survey will be updated as part of the CLG Grant.

STREET NAME: None at this time.

APPLIATIONS:
Frank Shuart, Docket #442: Let the minutes reflect that after a thorough review of the applications Mrs. Drago made a motion to approve Docket #442 and to request that the height of the proposed building not exceed the height of the existing structures. Mr. Gioni seconded the motion. The motion was approved with a vote of 6 yes and 0 no.

First Union Bank, Docket #429: Let the minutes reflect that after a thorough review of the application Ms. Kennedy made a motion to approve Docket #429 with the comment of concern regarding the demolition of the only Queen Anne house left in Mahwah and the lose of the vegetation. Mrs. Shanley seconded the motion. The motion to approve Docket #429 was denied with a vote of 3 yes and 3 no.

Tenafly Ford, DBS Park Avenue Ford, Docket #1049-02: Let the minutes reflect that after a thorough review of the application Mrs. Drago made a motion to approve Docket #1049-02 stating that the application has no historic significance and Ms. Kennedy seconded the motion. The motion was approved with a vote of 6 yes and 0 no.

DEMOLITION APPLICATIONS: None at this time.

MINUTES: Mrs. Drago made a motion to table the approval of the June 13, 2002 minutes until the August 8, 2002 meeting and Mrs. Shanley seconded the motion. The motion was approved with a vote of 6 yes and 0 no.

OLD BUSINESS:
*Isaac Bogert House Restoration: No report at this time.
*Historic Property Variance Sub-Committee: No report at this time.
*2002 Ornament : Mrs. Drago asked Ms. Kennedy if she would like to do the sketch of the 2003 ornament. Ms. Kennedy thanked Mrs. Drago for asking but declined stating lack of time. Mrs. Drago will send Mrs. Pope Wallin a letter asking her if she would like to sketch the drawing for the 2003 ornament.
*Historic Plaques: Mrs. Drago needs to clarify with Mrs. Tamayne the details in the Planning Boards resolution regarding the Beth Haverim Temple’s financial responsibility for the historic plaque. Mrs. Drago contacted Swear regarding the Valentine House plaque.
*Quackenbush Barn: Mrs. Drago reported that after speaking with Township officials it was decided that the planting of peach trees at the Quackenbush Barn site would not be recommended and she relayed this message to the Eagle Scout.
*Public Relations: Mrs. Drago sent press releases to the newspapers regarding the Cemetery Preservation Award.

BILLS:
The secretary reported that the NAPC $50 annual dues and PM Printing bill of $289.00 for the Bergen County Historic Survey books need approval. Mrs. Shanley made a motion to approve the bills as submitted and Ms. Kennedy seconded the motion. The motion was approved with a vote of 6 yes and 0 no.

GENERAL DISCUSSION: Mrs. Drago reported that the Commission had received an additional $785 from Bergen County Re-Grant Program for the Bergen County Sites Book which will be used for the deed surveys and archaeological survey for Mr. Nichols house and the write up on the Quackenbush Barn.

Mrs. Greene thanked Mrs. Drago for all her work on preparing and submitting the grant application for the historic survey book.

Mrs. Greene reported that she has received correspondence from Verizon concerning the installation of a cellular tower on Chad’s Barn roof. Mrs. Greene reported that Verizon had contacted the previous owners of the barn who in turn contacted Mrs. Greene to reply to Verizon that the tower would not be acceptable. Mrs. Drago reported that Verizon had contacted the MHPC a year ago and then told the MHPC that the plan was cancelled. Mrs. Drago reported that the MHPC had never received a formal application from Verizon. Mrs. Drago asked Mrs. Tamayne to look into this and report back to the MHPC at the August 8 meeting.

Mrs. Drago made a motion to close the MHPC meeting and Mrs. Shanley seconded the motion. The motion was unanimously approved.

These minutes are a synopsis of the MHPC tapes, which are on file at the Township Hall.
