PUBLIC MEETING MINUTES
THURSDAY, JANUARY 9, 2003
The meeting was called to order at 8:02PM by Council President Spiech who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record on July 12, 2002 stating this meeting would be held in the Municipal Offices, 300B Route 17 South, Mahwah, New Jersey on Thursday, January 9, 2003 at 8:00PM.
Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.
Present: Councilmembers Calandrillo, DaPuzzo, DiGiulio, Kelly, Paton, Richter and Spiech.
Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney Meneloas Toskos and Municipal Clerk Kathrine Coletta.
MAYOR MUTI FROM BOROUGH OF RAMSEY TO ADDRESS THE TOWNSHIP COUNCIL
Council President Spiech welcomed Mayor Muti and Councilman Jeff Heller from the Borough of Ramsey.
Mayor Muti introduced himself to the Council. The Mayor explained he is looking for ways to work with the Township of Mahwah. Mayor Muti briefly discussed several issues presently before the Borough of Ramsey and associated with the Township of Mahwah; drilling at the Ramapo Reservation and Home Depot. Mayor Muti thanked to Council for the opportunity to address the Council.
Spiech brought to Mayor Muti’s attention the Intergovernmental Committee. Mayor Muti answered Councilman Heller will be attending the meetings on behalf of the Borough of Ramsey.
APPROVAL OF BILLS AND CLAIMS
On a motion by Calandrillo, seconded by Kelly, the Bills and Claims, previously signed, totaling $5,176,689.89, were approved. Roll call vote: Calandrillo, yes; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Richter, yes; Spiech, yes. A list of Bills and Claims is on file in the Municipal Clerk’s Office.
REPORT OF TOWNSHIP COUNCIL AND MUNICIPAL CLERK
Calandrillo reported she recently toured the new town hall. She said it is coming along nicely. The Business Administrator reminded all the building is an active work site and not to enter the building unaccompanied.
DaPuzzo attended the Mahwah Schools Foundation Meeting. Last year, $78,000 in Mini Grants were generated.
DiGiulio reported the Beautification SubCommitee will be meeting on February 3, 2003 at 7:30PM. At the meeting, the SubCommittee will review Franklin Turnpike and Veteran’s Park as well as make plans and set an agenda for the next year. DiGiulio questioned if the Council intends for the SubCommittee to review religious displays. Mayor Martel shall report to the Council on the subject. Calandrillo suggested the meeting be held with the religious leaders of the Township for their input. Paton asked if those who did not respond were contacted. Spiech answered no.
Paton toured the new Town Hall with the Mayor this past Saturday. Paton suggested the Grand Opening of the building be held in May.
Spiech attended the Senior Citizens Luncheon. The seniors are looking for the building to be completed.
Spiech brought to the attention of the Council that the Schedule of Budget Meetings was distributed tonight. On Monday, Administration anticipates distributing the Budget to the Council.
Spiech referred to the communications problems with Emergency Services that was discussed at the Council Meeting last week. The Business Administrator answered he spoke to the EMS Director and the Police Chief. Monthly meetings will be held to discuss communications. Spiech also suggested a contact name be posted in the fire houses and ambulance buildings.
REPORT OF MAYOR AND BUSINESS ADMINISTRATOR
Mayor Martel thanked Mayor Muti and Councilman Heller from the Borough of Ramsey for attending the Council Meeting.
Spiech questioned if the hook up with United Water occurred. The Business Administrator answered no as a problem was encountered with the EFI Booster Station. Council will be kept informed of the situation.
GENERAL PUBLIC DISCUSSION
On a motion by Calandrillo, seconded by DaPuzzo, the meeting was opened to the public at 8:25PM. All in favor. Motion carried.
Mr. Phil Omsberg of 5 Halifax Road spoke of the buffer area at Continental Soldiers Park which is adjacent to homes on Halifax Road. Mr. Omsberg feels this area should be looked at as he feels some actions which occurred on the field were not part of the original plan. Mr. Omsberg is concerned about the shrubbery plan. Mr. Omsberg suggested the fence and berm should be extended to the bleacher area.
Mrs. Merrie Ed Omsberg of 5 Halifax Road feels the residents in the area are entitled to protection. Mrs. Omsberg suggested a compromise of extending the berm 212 feet. Mrs. Omsberg asked that this item be discussed at the January 16, 2003 Work Session Meeting and she be informed.
Mr. Ken Warnet of 37 Avenue spoke about his home and two others on his street which are zoned B40. Mr. Warnet explained it is difficult to do work on his property because of the zoning. Mr. Warnet is suggesting the three properties be rezoned residential (R5). Spiech requested this item be placed on the January 16, 2003 Work Session Agenda for further discussion. Kelly suggested the third property owner be notified. Administration shall handle. A resident of one of the properties questioned whether there will be any tax implications if the property is rezoned. Spiech suggested she contact the Tax Assessor.
Mr. Michael Packman of 222 Bush Lane inquired about cooperative and shared services with other government entities. The Business Administrator responded the Township does participate in State and County Cooperative Programs.
On a motion by Calandrillo, seconded by Richter, the meeting was closed to the public at 8:48PM. All in favor. Motion carried.
ORDINANCE - INTRODUCTION
The title of an Ordinance was read as follows:
AN ORDINANCE AMENDING CHAPTER 24 OF THE CODE OF THE TOWNSHIP OF MAHWAH TO REZONE LOT 1 IN BLOCK 57 FROM PUBLIC EDUCATION DISTRICT (PED) TO LIMITED OFFICE DISTRICT (LOD).
RESOLUTION - ORDINANCE NO. 1430
Introduced by DaPuzzo, seconded by Kelly.
RESOLVED that the Ordinance be passed and adopted on first reading.
FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be held on February 27, 2003 at the Municipal Offices, 300B Route 17 South, Mahwah, New Jersey at 8:00PM.
FURTHER RESOLVED that the Clerk shall publish said Ordinance with notice of introduction, passage and time and place where said Ordinance will be considered for final passage.

Resolutions #001-03 through #003-03, #005-03 through #012-03 and the Raffle Application for Beth Haverim were voted on under the Consent Agenda. Resolution #004-03 was voted on individually. Resolutions are attached to and made part of these Meeting Minutes.
Resolution #013-03 was tabled for two weeks.
Resolution #014-03 and the Raffle Application for the Mahwah Thunderbird Sports Boosters Club were voted on together. Resolution is attached to and made part of these Meeting Minutes.
On a motion by Calandrillo, second by Paton, the Raffle Application for HSO of Ramapo Ridge was approved. Roll call vote: Calandrillo, yes; DaPuzzo, abstained; DiGiulio, yes; Kelly, yes; Paton, yes; Richter, yes; Spiech, yes.

On a motion by Calandrillo, seconded by Kelly, the meeting was opened to the public at 9:01PM. All in favor. Motion carried.
Mr. Drew Baumgardt of 147 Second Street suggested when the Commodore Perry School property is sold a Joint Meeting be held with the Township and new property owner to discuss parking areas for both properties.
On a motion by DaPuzzo, seconded by Calandrillo, the meeting was closed to the public at 9:03PM. All in favor. Motion carried.
REPORT OF SUBCOMMITTEES
DaPuzzo distributed to Council a proposed plaque for Continental Soldiers Park. Richter and DiGiulio suggested the quotations “Yesterdays tomorrows, todays dreams” and “The past meeting the future”. Item will be discussed further at the January 16, 2003 Work Session Meeting.
Kelly informed Council the Transportation SubCommittee will be meeting on February 11, 2003.
Paton asked the Mayor when he meets with the Borough of Ramsey to discuss installing a light at the intersection of Darlington Avenue and Ridge Road.
Kelly thanked Mayor Muti and Councilman Heller for attending tonight’s meeting. Kelly was encouraged by the mention of open communications.
