HOUSING COMMISSION MEETING
Tuesday, December 3, 2002
Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement prescribed by law, called the meeting to order at 8:00 P.M. Notice of the meeting was published in the Ridgewood News on October 25, 2002, posted in the Township Hall and filed in the Township Clerk’s office.
Minutes of the meeting are available from the Township Clerk, the Secretary of the Housing Commission and the Municipal Web Site upon adoption by the Commission.

Present: Plicinski, Raiz, Ross, Snyder.
Absent: Brotherton, Calandrillo, Martel
Donna Tamayne, Associate Township Attorney was present.
Raiz made the motion to approve the minutes of the October 15, 2002 Housing Commission meeting. Snyder seconded. Motion passed. Plicinski abstained due to absence.
On a motion by Snyder, seconded by Plicinski the meeting was opened to the Public.
No Public in attendance.
Snyder made a motion to close the Public Portion. Plicinski seconded. Motion passed.
Letters were sent to several owners of affordable units, reviewing occupancy rules and regulations of the Affordable Housing Plan. In three cases, it was necessary for follow-up correspondence. (See Packet)
Tamayne reviewed the two units lost in Foreclosure and discussed the excess surplus funds, and will file a Turn Over Motion for alternative release either to ask for all surplus funds be turned over to the Township or to have the Affordable restrictions remain on the units.
Tamayne sent a letter to Scott Piekarsky, Attorney for Darlington Ridge Condominium Association; the Association was considering an option to foreclose on one of the Affordable units for arrears of monthly maintenance fees. However, they opted not to proceed. The owner paid the fees.
Housing Manager’s Reports
Report A – One unit remains listed for rent, owner not interested in offering it for sale, - three sales are pending, two rentals pending.
Report B – Owner of 921 Thoreau Court is in violation at the present time, if not corrected Commission will begin Court proceedings.
Report C – No changes
Report D – Foreclosure report - moved to Closed Session due to pending litigation
Report E & E-1 – Development Fees - current balance $465,797.43. Reed will follow-up on status of Dial America and Stryker Howmedics.
a. Unit expiration-Option to Buy – Tamayne will draft a letter for the Affordable Housing Dept. making owners of all Affordable units aware of the rules and regulations concerning expiration of the twenty-five year Affordable Housing Plan. The Commission, the Township of Mahwah, the Department of Community Affairs, or a non-profit entity is entitled to purchase the units at the maximum permitted sales price thus, keeping the units affordable.
b. Letter to finance companies concerning Township Ordinance regarding Affordable Housing Foreclosures – Tamayne will also work on drafting a letter to Mortgage Companies, making all concerned parties aware that the Township has the Right of First Refusal on any units going into Foreclosure.
Raiz will check with the Tax Collector’s Department to get a list of the Mortgage Companies enabling the Affordable Housing Dept. to notify all institutions holding mortgages on affordable units
The next Housing Commission meeting is Tuesday, January 21, 2003.
At 8:35 P.M., Snyder made a motion for Closed Session to discuss matters of litigation. Plicinski seconded. Motion carried.
At 9:15 P.M. Plicinski made the motion to return to the Public meeting. Snyder seconded. Motion approved.
Being no further business Raiz made the motion for adjournment at 9:15 P.M., seconded by Snyder. Ross wished one and all a Happy Holiday.
