TOWNSHIP OF MAHWAH
PUBLIC MEETING MINUTES
THURSDAY, APRIL 25, 2002

The meeting was called to order at 8:00PM by Council President Spiech who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record on July 20, 2001 stating this meeting would be held in the Municipal Offices, 300B Route 17 South, Mahwah, New Jersey on Thursday, April 25, 2002 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Present: Councilmembers Calandrillo, DiGiulio, Donigian, Omsberg, Richter and Spiech.
Absent: Councilman DaPuzzo.

Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney Meneloas Toskos and Municipal Clerk Kathrine Coletta.

APPROVAL OF BILLS AND CLAIMS
On a motion by Calandrillo, seconded by Omsberg, the Bills and Claims, previously signed, totaling $3,816,977.47, were approved. Roll call vote: Calandrillo, yes; DaPuzzo, absent; DiGiulio, yes; Donigian, yes; Omsberg, yes; Richter, yes; Spiech, yes. Motion carried. A list of Bills and Claims is on file in the Municipal Clerk’s Office.

APPROVAL OF MEETING MINUTES
On a motion by Omsberg, seconded by Calandrillo, the Work Session Meeting Minutes of April 4, 2002, Closed Session Meeting Minutes of April 4, 2002, Public Meeting Minutes of April 11, 2002 and Work Session Meeting Minutes of April 18, 2002 were approved. Roll call vote: Calandrillo, yes on Work Session Meeting Minutes of April 18, 2002 and abstained on remaining; DaPuzzo, absent; DiGiulio, yes; Donigian, abstained on Work Session Meeting Minutes of April 18, 2002 and yes to remaining; Omsberg, yes; Richter, yes; Spiech, yes.

REPORT OF TOWNSHIP COUNCIL AND MUNICIPAL CLERK
Calandrillo attended a Local Assistance Board Meeting. The number of General Assistance cases has increased to 3.

Calandrillo reported the construction on the Municipal Building is progressing.

DiGiulio attended a funeral for a firefighter recently. She was extremely proud of the Township’s Fire Department.

Donigian reported the Township will be celebrating Earth Day on May 4, 2002. The area to be cleaned up is Silver Lake. This is the Township’s Second Annual Clean-up.

Donigian reported the Mahwah/Ramsey Intergovernmental Meeting will be held on April 29, 2002 at 8:30PM. Sewer connection issues will be a topic of discussion. An update will be provided at the May 2, 2002 Work Session Meeting.

Donigian was invited by and attended the Board of Directors Meeting of the Apple Ridge Homeowners Association. The Board requested a presentation be given on the final Design Plan for the Airmont Avenue Recreational Facility. The three concerns of the Apple Ridge Homeowners Association were the field lighting, the public address system and the installation of a fence along Apple Ridge Boulevard.

Omsberg gave a Library Board Report. The Library Board is pleased the Council is looking into an Ordinance to protect minors. The Library appreciates the Police Chief’s efforts in providing quick responses to any calls. Omsberg, on behalf of the Library Board, thanked the Department of Public Works for replacing the picnic table and the trash receptacle fence.

Omsberg attended the Planning Board Meeting. Omsberg advised Council of the various actions taken by the Planning Board.

Omsberg understands the concerns of the residents of Apple Ridge. She advised she has requested the Council consider a Lighting Ordinance.

Spiech attended the Watershed Management Area 3 Meeting. On May 18th, 30 Scouts will be installing markers around the Township.

Spiech reported a Conference on the Ramapo River will be held at Ramapo College on April 26, 2002.

Spiech attended the Senior Citizens Luncheon today.

GENERAL PUBLIC DISCUSSION
On a motion by Calandrillo, seconded by Omsberg, the meeting was opened to the public at 8:20 PM. All in favor. Motion carried.

Mr. Arthur Lind of 71 Fisher Road thanked Donigian for making the presentation to the Apple Ridge Homeowners Association. Mr. Lind reiterated the concerns of the residents; lighting, the sound system and the fence installation.

Mr. Gary Paton of 83 Fisher Road distributed to the Council a handout on a Township Information Channel. On the channel, information on school closings, etc. would be available for residents to access via their cable television.

Mr. Mike DeLuca of 11 Parsons Court spoke on the recent Highlands Meeting. Mr. DeLuca suggested neighboring towns also become involved in the efforts. Mr. DeLuca further suggested a group of elected officials from area towns meet to discuss an approach to the problem. Spiech explained Mahwah and Oakland are the only two towns in the Highlands area.

Mr. Donald Marks of 202 Van Winkle Lane complimented Donigian for an outstanding presentation to the Apple Ridge Homeowners Association. Mr. Marks asked the Council to consider the residents that live within the area of the recreation field. Mr. Marks went on further to say the residents are concerned that their property values will be decreased.

Mrs. Irmgard Santaiti of 243 Airmont Avenue explained she is upset over the entire Airmont Avenue Recreation Field. She feels the Township is destroying her residence.

On a motion by Calandrillo, seconded by Omsberg, the meeting was closed to the public at 8:37PM. All in favor. Motion carried.

ORDINANCE - INTRODUCTION
The title of an Ordinance was read as follows:
AN ORDINANCE AMENDING SECTION 16-34 OF THE MUNICIPAL CODE OF THE TOWNSHIP OF MAHWAH ENTITLED “WATER RESTRICTIONS”.

RESOLUTION – ORDINANCE NO. 1416

Introduced by Calandrillo, seconded by Richter.

RESOLVED that the Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be held on May 9, 2002 at the Municipal Offices, 300B Route 17 South, Mahwah, New Jersey at 8:00PM.

FURTHER RESOLVED that the Clerk shall publish said Ordinance with Notice of Introduction, passage and time and place where said Ordinance will be considered for final passage.

Roll call vote: Calandrillo, yes; DaPuzzo, absent; DiGiulio, yes; Donigian, yes; Omsberg, abstain; Richter, yes; Spiech, yes.

RESOLUTIONS
Resolution #113-02 (Resolution for the Approval of the Local Municipal Budget) and #114-02 (Resolution to Read the 2002 Municipal Budget By Title Only) are attached to and made part of these Meeting Minutes.

ORDINANCES - PUBLIC HEARINGS
The title of an Ordinance was read as follows:
2002 MUNICIPAL BUDGET

On a motion by Calandrillo, seconded by Omsberg, the meeting was opened to the public.

Mr. Mike DeLuca of 11 Parsons Court asked various questions on the Municipal Budget all of which were answered by the Chief Financial Officer.

Mr. Donald Marks of 202 Van Winkle Lane expressed concern over the Township having surplus. The Chief Financial Officer explained this money is set aside in the event the Township experiences a catastrophe.

Mr. Gary Paton of 83 Fisher Road commended the Council on the job done with the Budget. Mr. Paton thanked the Council for their positive business approach on the budget.

Mr. John Kelly of 238 Miller Road commended the Council on the job they did on the Budget.

On a motion by Richter, seconded by Calandrillo, the meeting was closed to the public. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Spiech, the following resolution was passed and adopted:

RESOLUTION – ORDINANCE NO. 1411

RESOLVED that the Ordinance be passed and adopted on second reading and the Clerk is authorized to advertise by title only as having been finally adopted, as required by law.

Roll call vote: Calandrillo, yes; DaPuzzo, yes; DiGiulio, yes; Donigian, yes; Omsberg, yes; Richter, yes; Spiech, yes.

The title of an Ordinance was read as follows:
AN ORDINANCE TO VACATE THE ENTIRE PUBLIC ROADWAY DESIGNATED AS COMMERCE COURT IN THE TOWNSHIP OF MAHWAH, BERGEN COUNTY, NEW JERSEY.

On a motion by Calandrillo, seconded by Omsberg, the meeting was opened to the public. All in favor. Motion carried.

Being no comments were made from the public, on a motion by Omsberg, seconded by Calandrillo, the meeting was closed to the public. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Omsberg, the following resolution was passed and adopted:

RESOLUTION – ORDINANCE NO. 1414

RESOLVED that the Ordinance be passed and adopted on second reading and the Clerk is authorized to advertise by title only as having been finally adopted, as required by law.

CONSENT AGENDA
Resolutions #115-02, #116-02, #118-02 through #122-02 were voted on under the Consent Agenda. Resolution #117-02 was removed from the Consent Agenda. Resolutions are attached to and made part of these Meeting Minutes.

RESOLUTION
Resolution #117-02 (Professional Services Agreement; Boswell-McClave Engineering; Construction Engineering and Inspection Services Associated with the Route 202 Recreation Facility) was voted on and is attached to and made part of these Meeting Minutes.

NEW BUSINESS
Resolution #123-02 (Place-To-Place Transfer of Liquor License; Scherer and Company, Inc.) was voted on separately and is attached to and made part of these Meeting Minutes.

GENERAL PUBLIC DISCUSSION
On a motion by Calandrillo, seconded by Omsberg, the meeting was opened to the public at 9:07PM. All in favor. Motion carried.

Being no comments were made by the public, on a motion by Richter, seconded by Omsberg, the meeting was closed to the public at 9:08PM. All in favor. Motion carried.

COUNCIL COMMENTS/COMMUNICATIONS
Donigian referenced inconsistencies in an article which recently appeared in The Suburban News on the Airmont Avenue Recreation Facility.

Mayor Martel stated he was pleased the Budget was adopted. The Mayor thanked the Department Heads and Council. The Mayor also thanked the public for coming out.

On a motion by Omsberg, seconded by Calandrillo, the meeting was adjourned at 9:15PM. All in favor. Motion carried.
