TOWNSHIP OF MAHWAH
PUBLIC MEETING MINUTES
THURSDAY, JUNE 8, 2006

The meeting was called to order at 8:03PM by Council President Kelly who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record on July 29, 2005 stating this meeting would be held in the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey on Thursday, June 8, 2006 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag

Present: Councilmembers Alderisio, DiGiulio, Kelly, Paton, Richter and Roth.
Absent: Councilmember Calandrillo

Also present were Mayor Richard J. Martel, Township Attorney Terry Paul Bottinelli and Municipal Clerk Kathrine G. Coletta.


CONTINUATION OF PUBLIC HEARING; VERIZON
On a motion by Roth, seconded by Paton, the Public Hearing on Verizon shall be carried to the June 22, 2006 Public Meeting pending receipt of the additional information requested. Roll call vote: Alderisio, yes; Calandrillo, absent; DiGiulio, yes; Paton, yes; Richter, yes; Roth, yes; Kelly, yes. Motion carried.

APPROVAL OF BILLS AND CLAIMS
On a motion by Richter, seconded by Roth, the Bills and Claims, previously signed, totaling $4,714,537.01, were approved. Roll call vote: Alderisio, yes; Calandrillo, absent; DiGiulio, yes; Paton, yes; Richter, yes; Roth, yes; Kelly, yes. Motion carried. A List of Bills and Claims is on file in the Municipal Clerk’s Office.

APPROVAL OF MEETING MINUTES
On a motion by Richter, seconded by Roth, the Work Session Meeting Minutes of January 19, 2006 and February 16, 2006, Budget Work Session Meeting Minutes of February 18, 2006, Public Meeting Minutes of February 23, 2006, March 23, 2006 and April 27, 2006 and the Closed Session Meeting Minutes of February 16, 2006, March 16, 2006 and April 27, 2006 were approved. All in favor. Motion carried.

REPORTS OF TOWNSHIP COUNCIL and MUNICIPAL CLERK
DiGiulio - The Beautification Committee met. The next Clean Up will be on September 30th.

DiGiulio thanked Gerry and Bill Savino for decorating the bell.

DiGiulio informed everyone at the June 22nd Council Meeting Certificates of Appreciation will be given to those who participated in the last Clean Up.




TOWNSHIP COUNCIL: COMMENTS, COMMUNICATIONS and REPORTS OF SUBCOMMITTEES
Alderisio reported he was unable to attend the last Senior Citizens Advisory Board Meeting.

DiGiulio attended the DARE Graduation.

Paton questioned if the sprinklers at the pool have been installed and are they operational.

Roth reported on June 6th the Cable Television Committee met. Five confirmations have been received from residents interested in serving on the Committee.

Roth reported a request has been received from the Director of the Senior Center to post Lee Vold Day on Channel 78.

Roth asked for an update on the sale of the house on Airmont Avenue. The Mayor answered upon his return the Business Administrator will be advertising same.

Kelly reported the Reorganization Meeting will be held on July 6th at 8:00PM.

DiGiulio reported Officer Connington of the Police Department participated in the Cop Drop to raise money for children with leukemia. Officer Connington made 17 jumps and raised over $5,000.

REPORTS OF MAYOR and BUSINESS ADMINISTRATOR
Mayor Martel attended the DARE Graduation. Over 200 students took part in the Program. The Mayor complimented the DARE Officers on doing a fantastic job.

The Mayor reported a meeting has been scheduled with the DOT Commissioner for June 26th to discuss I-287.

PUBLIC PORTION
On a motion by DiGiulio, seconded by Roth, the meeting was opened to the pubic at 8:13PM. All in favor. Motion carried.

Mrs. Dawn DiLeone of 11 Aspen Court complained about the sirens from Fire Company #3. She feels this is a health issue. Mrs. DiLeone pointed out other towns in Bergen County do not rely on sirens and questioned why Mahwah needs to. Mrs. DiLeone does not feel that all firefighters are effected by pagers not working in dead spots.

Miss Amanda Buono of 11 Aspen Court complained when the sirens go off they make her and her brothers ears hurt. She asked for the fire sirens to not be used.

A resident (name inaudible on CD) whom lives across the street from Fire Company #2 asked the following questions:
1. How much money is allocated for the communications system for firefighters?
2. What types of radios are being used today and when were they purchased? Are all of the radios the same?
3. The name of the person in charge of resolving the problem.



Mr. Chrisopher DiLeone 11 Aspen Court feels that as a result of the fire sirens repeatedly going off his childrens health is at risk.

Mr. Peter Cassoitis of 107 South Mahwah Road stated when he was in college and the fire alarm was pulled for a false alarm the college was charged $500. From that point on the number of false alarms decreased dramatically.

Mr. Albert Kidd of 851 Darlington Avenue complained the Township is losing money by not renting the Township property at 25 East Ramapo Avenue. Mr. Kidd asked if the Historic Preservation Committee has provided comments. Kelly answered no.

On a motion by Alderisio, seconded by Paton, the meeting was closed to the public at 8:42PM. All in favor. Motion carried.

ORDINANCES - INTRODUCTIONS
The title of an Ordinance as read as follows:
AN ORDINANCE ESTABLISHING A COMMUNITY CABLE TELEVISION COMMITTEE IN THE TOWNSHIP OF MAHWAH.

RESOLUTION – ORDINANCE NO. 1548

Introduced by Roth, seconded by Paton.

Council concurred the following changes shall be made to the proposed Ordinance:
1. Committee shall consist of minimum of 5 members and up to 9 members.
2. Initial terms of appointees shall be 3 members for 1 year, 3 members for 2 years
and 3 members for 3 years. Thereafter all appointments shall be for 4 years.
3. Council Liaison shall be for a term of 1 year.

RESOLVED that the Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be held on June 22, 2006 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey on 8:00PM.

FURTHER RESOLVED that the Municipal Clerk shall publish said Ordinance with Notice of introduction, passage and time and place where said Ordinance will be considered for final passage.

RESOLUTION – ORDINANCE NO. 1549



Introduced by Alderisio, seconded by Richter.

RESOLVED that the Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be held on June 22, 2006 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey at 8:00PM.

FURTHER RESOLVED that the Municipal Clerk shall publish said Ordinance with notice of introduction, passage and time and place where said Ordinance will be considered for final passage.

CONSENT AGENDA
Resolutions #129-06 through #135-06 and the Raffle Applications for HSO Lenape Meadows (50/50, On Premise), HSO Lenape Meadows (On Premise) and Ramapo College of New Jersey Alumni Association (Off Premise) were approved under the Consent Agenda. Resolutions are attached to and made part of these Meeting Minutes.

RESOLUTIONS
Resolutions #136-06 and #137-06 were voted on separately and are attached to and made part of these Meeting Minutes.

On a motion by Richter, seconded by Roth, the meeting was adjourned at 9:03PM. All in favor. Motion carried.
