Tuesday, December 13, 2005

The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, December 13, 2005.

Notice of the meeting is posted on the Municipal Bulletin Board and the Municipal Web-site. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.

Present Commission Members: Brotherton, Martel, Raiz, Ross and Snyder.

Also present, Nilufer DeScherer, Associate Township Attorney.

Absent Commission Members: Calandrillo and Wiley.

Brotherton made a motion, seconded by Snyder to approve the minutes of the November 7, 2005 Housing Commission meeting. All in favor. Motion carried.

Brotherton made the motion, seconded by Snyder to approve the minutes of the November 7, 2005 Executive Session, as presented. All in favor. Motion carried.


On a motion by Snyder, seconded by Brotherton the meeting was open to the Public. All in favor. Motion carried.

No Public in attendance.

Brotherton moved to close the Public Portion, seconded by Raiz. All in favor. Motion approved.


Correspondence was reviewed and discussed.


Report A – Sales/Rentals – Two (2) units available for rent, two (2) units with sales pending and three (3) units have closed.

Report B – Violations/Potential Violations:

488 Quince Court –DeScherer spoke to the County Clerk’s office, the Deed was recorded, and they will forward a copy to her office.

Report C – Pending Foreclosures – No Changes

Report D – Current Foreclosures:

389 Poet’s Way –Moved to Executive Session

914 Thoreau Court – There has not been a date scheduled for the Sheriff’s Sale Foreclosure proceeding.

2010 Hawthorne Lane –Owner filed an Answer and Counter Claim in Foreclosure against Wachovia SBA Lending, Inc. which will be heard in the Superior Court of New Jersey, Bergen County, Chancery Division.

Report E thru E-3 Affordable Housing Trust Fund- Present balance $1,115,048.73.


a. 389 Poet’s Way- Ameriquest Mortgage Co./Selensky- Moved to
Executive Session.
b. 488 Quince Court – Moskel – Copy of the newly recorded Deed
will be forwarded to DeScherer’s office by the County Clerk’s office.
c. Spending Plan – DeScherer will meet with the Affordable Housing Dept.
to prepare the proper forms to be used per COAH’s new Rules and Regulations.
d. 2010 Hawthorne Lane-Butler – See above.


a. Procedure for Sheriff’s Sale – DeScherer will prepare procedure.
b. Power of Attorney Forms – DeScherer will format the procedure.
c. 1168 Sycamore Lane – Christie- Deed Transfer- DeScherer will research allowable Transfers regarding Exempt transactions.
d. 1523 Faulkner Court- Dodd- A letter was sent to the owners regarding
refinancing of the unit.

At 7:30 PM, Snyder moved that the Housing Commission consult in private with its Attorney concerning the Commission’s Legal rights and duties in reference to specific matters; the exact discussion will not be disclosed. However, any action to be taken by the Commission as a result of said conference shall be taken in public. Brotherton seconded.

DeScherer addressed the matters to be discussed in the Executive Session as the following:

a. 389 Poet’s Way-Selensky/Ameriquest Mortgage Company
b. 1523 Faulkner Court – Dodd
c. 2010 Hawthorne Lane- Butler
d. Letter from Ridge Gardens Condominium Association, Inc.

At 7:50 PM Snyder made the motion, seconded by Brotherton to return to Open Session.
All in favor. Motion carried.

In reviewing the letter from Ridge Gardens Condominium Association, Inc. the Housing Commission did not feel they had the authority to approve the request. Raiz will respond to the Association letter and forward a copy to COAH in Trenton for guidance.

Being no further business Brotherton made the motion for adjournment at 8:05 PM. Snyder seconded. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Tuesday, January 17, 2006 at 7:00 PM in room 311 of the Municipal office complex.
