Tuesday, October 18, 2005

The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, October 18, 2005.

Notice of the meeting is posted on the Municipal Bulletin Board and the Municipal Web-site. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.

Present Commission Members: Calandrillo Raiz, Ross and Snyder.

Also present, Nilufer DeScherer, Associate Township Attorney.

Absent Commission Members: Brotherton, Martel.

Calandrillo made a motion, seconded by Snyder to approve the amended minutes of September 20, 2005 Housing Commission Meeting, by changing the word Council on page three to Counsel and on page four the word at to as. All in favor. Motion carried.

Calandrillo made the motion, seconded by Snyder to approve the minutes of September 20, 2005 Executive Session. All in favor. Motion carried.


On a motion by Calandrillo, seconded by Raiz the meeting was open to the Public. All in favor. Motion carried.

No Public in attendance.

Calandrillo moved to close the Public Portion, seconded by Raiz. All in favor. Motion carried.


Correspondence was reviewed.


Report A – Sales/Rentals – One (1) unit available for rent, seven (7) sales pending, three (3) rentals pending.

Report B – Violations/Potential Violations-

488 Quince Court –Moved to Executive Session
735 Pepperidge Court –Moved to Executive Session

Report C – Pending Foreclosures - No changes

Report D – Current Foreclosure List:

389 Poet’s Way –DeScherer reported she has left several messages for the
Attorney and will follow up with a letter requesting enforcement of the Court Order.
914 Thoreau Court- DeScherer reviewed Ordinance No. 1481 and did
not find it necessary to make any changes. When
the unit goes to Sherriff’s Sale, the Township will be
represented. DeScherer will prepare a procedure
to be followed for units going into Foreclosure.
2010 Hawthorne Lane – DeScherer advised the Foreclosure Court in
Trenton that the Township will be filing a
Motion to Intervene. Raiz was contacted by
the owner and the issues were discussed.

Report E thru E-3 Affordable Housing Trust Fund – Present balance $1,087,094.32, year to date Development Fees collected $111,630.50.


a. 389 Poet’s Way-Selensky - Moved to Executive Session
b. 488 Quince Court –Moskel - DeScherer reported the Repayment Mortgage Note was Notarized and the Original Note received by the Township. DeScherer will contact the County Clerk’s office and find out if it has been recorded.
c. Spending Plan –Moved to Executive Session
d. 735 Pepperidge Road-Wraga – DeScherer’s office will be filing a Complaint in Small Claims Court on behalf of the Township.

e. 914 Thoreau Court –Parks –See above-Report D
f. 2010 Hawthorne Lane –Butler See above –Report D


a. Housing Commission Vacancy – Ross asked the members to make suggestions for presentation to the Mayor.

Ross moved that the Housing Commission consult in private with its Attorney concerning the Commission’s Legal Rights and duties in reference to specific matters; the exact discussion will not be disclosed. However, any action to be taken by the Commission as a result of said conference shall be taken in public.

At 7:20 PM Calandrillo made the motion, seconded by Raiz to enter into Executive Session. All in favor. Motion carried. The following pending Legal matters are to be discussed:

a- 389 Poet’s Way – Selensky
b- Spending Plan
c- 735 Pepperidge Road – Wraga
d- 2010 Hawthorne Lane- Butler

At 7:50 PM Calandrillo made the motion, seconded by Raiz to return to Open Session. All in favor. Motion carried.

DeScherer will prepare a letter to the Township Council suggesting amendments be made to the approved Municipal Development Fee Spending Plan and forwarded to the Council on Affordable Housing in Trenton.

Being no further business, Raiz made the motion for adjournment at 7:50 PM. Snyder seconded. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Monday, November 7, 2005 at 7:00 PM in room 311 of the Municipal office complex.
