Tuesday, June 21, 2005

The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, June 21, 2005.

Notice of the meeting is posted on the Municipal Bulletin Board. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present Commission Members: Brotherton, Calandrillo, Raiz and Ross.

Also present, Nilufer DeScherer, Associate Township Atty.

Absent Commission Members: Martel, Plicinski and Snyder.

Brotherton made the motion, seconded by Raiz, to approve the minutes of the May 17, 2005 Housing Commission meeting. Raiz referred to the approved amount of up to $20,000.00 for the Burgis proposal to complete the Housing Element & Fair Share Plan required by COAH versus the letter sent by DeScherer to Lucy Voorhoeve, Executive Director of COAH on June 13, 2005 stating an approximate $25,000.00 amount. DeScherer explained this amount would be the permitted 20% of the anticipated collection of Development Fees of $125,000.00 for the 2005 year for the allowed use of administrative expenses. All in favor. Motion carried. Calandrillo abstained due to absence.

Brotherton made the motion, seconded by Raiz, to approve the minutes of the Closed Session of May 17, 2005 Housing Commission meeting. All in favor. Motion carried. Calandrillo abstained due to absence.


On a motion by Calandrillo, seconded by Brotherton the meeting was opened to the Public. Motion approved.

No Public in attendance.

Calandrillo moved to close the Public Portion. Brotherton seconded. Motion carried.

Correspondence was reviewed including the letter to Lucy Voorhoeve; Executive Director of COAH mentioned above.


Report A –Sales/Rentals – Report A –two (2) units listed for sale, one (1) unit listed for rent. There are seven (7) sales pending and five (5) rentals pending.

Report B- Violations/Potential Violations – The following units were discussed:

107 Raintree Lane - Reed send a letter to the owner on May 19, 2005
outlining the violation and fines. She has been in contact with the owner’s son; several items were requested and are due no later than June 30, 2005.
488 Quince Court – DeScherer spoke to the owner’s Atty. he will be
meeting with his client to address the issue. Further discussion moved to
Executive Session.
735 Pepperidge Court – Reed reported she and Raiz appeared in Bergen
County Municipal Court on June 3, 2005, after discussion with the County
Prosecutor the case was dismissed without Prejudice by the Judge.
DeScherer will file a Complaint in Bergen County Small Claims Court. .Further discussion moved to Executive Session.
775 Sassafras Court –Unit is to be rented as of July 1, 2005
1523 Faulkner Court –DeScherer has not received a response to her letter of May 17, 2005 written to Ameriquest Mortgage Company.
2114 Hawthorne Lane – The unit was listed for sale as of June 13, 2005.

Report C- Pending Foreclosures – No Changes.

Report D – Current Foreclosures:

389 Poet’ Way - DeScherer left a message for the Atty. of Ameriquest Mortgage Co.; she thinks the Sheriff’s Sale may occur sometime in July. The Township has the right to purchase the unit at the Sheriff’s Sale.
914 Thoreau Court –Raiz wrote a letter to the owner, the Mortgage
Company and the Attorney for Ridge Gardens Association regarding the
possible Foreclosure. There has been no response.

Report E – thru E-3 Affordable Housing Trust Fund- Reed reported a balance of $1,052,459.76. Development Fees collected for 2005 through June 15th are $64,018.00.

f. Rentals – Moved to Executive Session
g. Uniform Housing Affordability Controls –Moved to Executive Session
h. 2005-2006 Affordable Housing Meeting Schedule –Calandrillo made the motion, seconded by Brotherton to approve the schedule.
All in favor. Motion carried.

At 7:30 PM Calandrillo made the motion, seconded by Brotherton to enter into Executive Session to discuss the following Legal matters:

a- 488 Quince Court – Moskal
b- 691 Plum Terrace – Leff
c- 735 Pepperidge Road – Wraga
d- Uniform Housing Affordability Controls

Motion approved.

At 7:55 PM Calandrillo made the motion to return to Open Session. Brotherton seconded. All in favor. Motion carried.

Being no further business, Calandrillo made the motion for adjournment at 8:00 PM. Raiz seconded. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Tuesday, July 19, 2005 at 7:00 PM in room 311 of the Municipal Building.
