Tuesday, July 19, 2005

The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, July 19, 2005.

Notice of the meeting is posted on the Municipal Bulletin Board. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present Commission Members: Brotherton, Calandrillo, Raiz and Ross

Also present (7:20 PM), Nilufer DeScherer, Associate Township Atty.

Absent Commission Members: Martel, Plicinski and Snyder.

Calandrillo made a motion, seconded by Brotherton to approve the minutes of the June 21, 2005 Housing Commission meeting. All in favor. Motion carried.

Calandrillo made the motion, seconded by Brotherton to approve the minutes of the June 21, 2005 Executive Session. All in favor. Motion carried.


On a motion by Brotherton, seconded by Calandrillo the meeting was open to the Public.
All in favor. Motion carried.

No Public in attendance.

Calandrillo moved to close the Public Portion, Brotherton seconded. All in favor. Motion carried.


Correspondence was reviewed.

DeScherer has not received a response to her letter of June 21, 2005 to Lucy Voorhoeve, Executive Director of COAH.

Raiz reviewed the letter from Burgis Associates, Inc, Township Planner regarding the information necessary to complete the draft of his report. Burgis is awaiting data on approved and pending development applications from the Planning/Zoning office. Ross reported there are several individuals working on the project and feels the information will be forthcoming shortly.


Report A- Sales/Rentals –Report A- Eleven (11) units with sales pending, six (6) units with rentals pending.

Report B – Violations/Potential Violations – The following units were discussed:

107 Raintree Lane –Moved to Executive Session
488 Quince Court – Moved to Executive Session
735 Pepperidge Court –Moved to Executive Session
775 Sassafras Court - Unit was rented to a Certified Household as of July 4, 2005.
1523 Faulkner Court –Nothing new to report.
2114 Hawthorne Lane –Unit has a sale pending.

Report C – Pending Foreclosures – No changes.

Report D – Current Foreclosures:

389 Poet’s Way – DeScherer had a conference call with two Ameriquest Attorneys. Further discussion moved to Executive Session.
914 Thoreau Court –Moved to Executive Session.

Report E-thru E-3 Affordable Housing Trust Fund – Reed reported a balance of $1,063,299.38. 2005 year to date development fees collected as of July 13, 2005, $73,268.00.

At 7:30 PM Brotherton made the motion, seconded by Calandrillo to enter into Executive Session to discuss the following Legal matters:
a- 107 Raintree Lane
b- 389 Poet’s Way
c- 488 Quince Court
d- 735 Pepperidge Road
e- 914 Thoreau Court

Motion approved.

At 8:15 PM Calandrillo made a motion, Brotherton seconded, to return to Open Session. All in favor. Motion carried.

107 Raintee Lane-Mian- Calandrillo made a motion to reimburse the tenant, by credit, towards future rents in the amount of $1,960.00. The owner is to pay the rental fee of $500.00 to the Township of Mahwah, Affordable Housing Dept. Brotherton seconded. All in favor. Motion carried. Reed will inform the owner.

389 Poet’s Way –Ameriquest Mortgage Co. – Brotherton made the motion for DeScherer to contact the Ameriquest Attorney requesting an Order from the Judge allowing a private sale to the Township of Mahwah for the Maximum Permitted Sales Price. Otherwise the unit will be sold at Sheriff’s Sale. Calandrillo seconded. All in favor. Motion approved.

914 Thoreau Court –Parks – Calandrillo made a motion to authorize $3,000.00 in Mortgage Assistance to be paid to the bank, pursuant to the Township’s Spending Plan, in light of the pending foreclosure action against the owner. This is subject to the owner executing a Power of Attorney giving the Township the right to redeem. In addition, the owner would be required to sign any other COAH Mortgage documents which would allow the Township to intervene in this Case. Brotherton seconded. All in favor. Motion approved.

488 Quince Court –Moskal- No response.

735 Pepperidge Court –Wraga – DeScherer will review the information.

Being no further business, Calandrillo made the motion for adjournment at 8:20PM. Brotherton seconded. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Tuesday, September 20, 2005 at 7:00 PM in room 311 of the Municipal office complex, unless it becomes necessary to call a meeting in August to review a draft from Burgis Associates on the implementation portion of the Plan with a growth share projection for the Housing Element & Fair Share Plan as required by COAH.
