The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Ridgewood News on October 29, 2004 stating the meeting would be held in room 311 in the Municipal Offices located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, April 19, 2005.

Notice of the meeting is posted on the Municipal Bulletin Board. The minutes of the meeting shall be available form the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present Commission Members: Brotherton, Martel, Plicinski, Raiz, Ross and Snyder.

Also present, Nilufer DeScherer, Associate Township Atty.

Absent Commission Member: Calandrillo.

Plicinski made the motion, seconded by Snyder, to approve the minutes of the March 15, 2005 Housing Commission meeting. All in favor. Motion carried. Brotherton and Martel abstained due to absence.

Snyder made a motion, seconded by Plicinski, to approve the minutes of the Closed Session of March 15, 2005. All in favor. Motion carried. Brotherton and Martel abstained due to absence.


Plicinski, made the motion, seconded by Brotherton to open the Public Portion of the meeting. All in favor. Motion carried.

Sophie Moskal owner of 488 Quince Ct., Mahwah and her associate Eva Chorno, 801 Pond Brook Rd., Franklin Lakes addressed the Commission regarding Ms. Moskal owning two Affordable Housing units, one in Mahwah and one in Saddle River. Following the comments made by Moskal and Chorno, the Commission moved further discussion to Closed Session.

Snyder moved to close the Public Portion. Raiz seconded. All in favor. Motion carried.


DeScherer’s letter to Lucy Voorhoeve, Executive Director of the Council on Affordable Housing in Trenton, regarding the Township’s updated efforts to implement its spending plan was reviewed. Raiz asked if the no rental clause should be added to Section II, paragraph b, under Affordability Assistance. DeScherer will add this language to the Attorney letters which Reed sends out, it does not require COAH’s approval. Martel asked how paragraph c, Hardship Assistance would be handled? DeScherer will check if a Hardship Assistance payment can be sent directly to a Mortgage Company by the Twp. should the need arise.

The Commission reviewed the letter received from the owner of 691 Plum Terrace regarding the $500.00 rental fee. After a lengthy discussion the Commission unanimously concluded that this is the policy in place and in order to maintain a fair program, everyone must adhere to the same regulations.

Brotherton made the motion that the $500.00 fee is due and payable each time an owner rents a unit to a new tenant. Seconded by Snyder.

Louis Barbuto, Mgr. of Norfolk Village senior complex, notified the Commission the income limits for 2005 will remain the same as 2004; there will not be any rental increase for the 2005 rental year.

Reed’s letter to the owner of 107 Raintree Lane regarding a potential violation was discussed.

The issue at 2114 Hawthorne Lane was revisited, the owner has until June 1, 2005 to bring the unit into compliance or the Commission will commence enforcement actions.

Raiz’s letter to owner of 775 Sassafras Ct. was reviewed - the Housing Dept. has a rental pending on the unit with a tentative move in date of July 1, 2005.

DeScherer left voice mail for Christopher Carton, Attorney for Ameriquest Mortgage Co. regarding the status of 389 Poet’s Way and 1523 Faulkner Court.


Report A- Sales/Rentals- five units listed for rent, two sales pending, 3 rentals pending.

Report B- Violations/Potential Violations – The following units were discussed:
107 Raintree Lane
488 Quince Court
775 Sassafras Court
1523 Faulkner Court
2144 Hawthorne Lane

Report C- Pending Foreclosures – No changes

Report D – Current Foreclosures – DeScherer is working with the Attorney for Amerquest.

Report E thru E-3 Affordable Housing Trust Fund- Account balance $1,017.933.62. Reed will add the fees collected on a monthly basis to the report.


a. Violations – Moved to Closed Session.

At 8:15 PM Plicinski made the motion, seconded by Brotherton, to enter into Closed Session for the purpose of discussing litigation with Sophia Moskal and Elaine L. Buccisano-Wraga. All in favor. Motion carried.

At 9:00 PM Brotherton made a motion, seconded by Plicinski, to return to open session. All in favor. Motion carried.

Having discussed the Moskal situation at 488 Quince Ct, on a motion by Committee, DeScherer is authorized to contact Moskal and her Atty. regarding the fraudulent application made to the Township of Mahwah.

Moskal must divest herself completely with no ownership whatsoever of the unit in Saddle River within sixty (60) days of DeScherer’s written notice. The Township would then allow her to retain ownership of the Mahwah unit subject to a written agreement that she would occupy the unit, not rent the unit as long as she retains ownership, and have no other occupants.

She or her Attorney must furnish written proof from the Mortgage Company and the Lien Company within sixty (60) that she has relinquished all ownership of the Saddle River unit.

Motion approved.


DeScherer reported Burgis Associates; Township Planner has sent her a copy of the Proposal to prepare a Third Round Housing Element and Fair Share Plan requested by COAH. The fee would be capped at $20,000.00. The Commission requested a copy of the proposal for review at the May meeting.

Being no further business, Plicinski made the motion for adjournment at 9:05 PM. Brotherton seconded. All in favor. Motion carried.

The next scheduled Housing Commission meeting is Tuesday, May 17, 2005 at 7:00 PM in room 311 of the Municipal Office Complex.
