HOUSING COMMISSION MEETING
TUESDAY, MARCH 15, 2005
The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Ridgewood News on October 29, 2004 stating the meeting would be held in room 311 in the Municipal Offices located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, March 15, 2005.
Notice of the meeting is posted on the Municipal Bulletin Board. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.
The meeting was moved to room 319 due to the power point presentation by Joseph Burgis, of Burgis Associates, Inc., Community Planning and Development Consultants.

Present: Commission members Calandrillo, Plicinski, Raiz, Ross, Snyder.
Also present, Nilufer DeScherer, Associate Township Atty.
Absent: Commission members Brotherton and Martel.
Snyder made the motion, seconded by Raiz, to approve the minutes of the February 15, 2005 Housing Commission meeting. All in favor. Motion carried. Calandrillo abstained due to absence.
Snyder made a motion, seconded by Plicinski, to approve the minutes of the Closed Session of February 15, 2005. All in favor. Motion carried. Calandrillo abstained due to absence.
Raiz made the motion, seconded by Calandrillo to open the Public Portion of the meeting. All in favor. Motion carried.
Seeing no public in attendance, Calandrillo moved to close the Public Portion. Raiz seconded. All in favor. Motion carried.
Correspondence was reviewed.
HOUSING MANAGER’S REPORTS
Report A- Sales/Rentals – One sales pending, four rentals pending.
Report B-Violations/Potential Violations – The following units were discussed:
107 Raintree Lane
488 Quince Court
735 Pepperidge Court
775 Sassafras Court
2114 Hawthorne Lane
Report C-Pending Foreclosures- No changes.
Report D – Current Foreclosures- DeScherer contacted the Ameriquest Attorney, Sheriff’s Sale has not been scheduled for 389 Poet’s Way.
Report E thru E-3 Affordable Housing Trust Fund – Account balance $1,012,422.23
a. Amended Spending Plan – DeScherer reviewed the proposed amendments to the Spending Plan as a result of the sub-committee meeting of March 1, 2005.
A discussion and several additional suggestions were offered by Commission members. DeScherer will submit a draft proposal with the suggested amendments to Lucy Voorhoeve, Executive Director of the Council on Affordable Housing in Trenton, for consideration. Raiz asked, if necessary, can the Spending Plan can be reviewed and amended from time to time?
DeScherer answered in the affirmative. Once approval is received from COAH on the amendments, a Housing Commission Resolution will be formulated for submission to Township Council for endorsement. In addition, DeScherer is also sending a detailed update to Keith Henderson, of COAH, within the requested forty-five day time period, on how the Township is planning to use the Development fee funds.
DeScherer stated there is a time line to follow; a Third Round Housing Element and Fair Share Plan must be submitted to COAH by December 20, 2005. Before that Burgis Associates will need to submit a proposal for scope of work and fees. Then a Special Services Agreement will need to be drawn up by the Governing Body.
b. Violations – See above, Report B. - 1523 Faulkner Court moved to Closed
c. Substantive Certification- At 7:40 PM, Joseph Burgis, Township Planner
began a power point presentation on the potential impact of the third round COAH methodology for Substantive Certification. In the first and second round of Substantive Certification a Fair Share Plan calculation was used by COAH. In the third round a Growth Share methodology has been adopted. Burgis reviewed Mahwah’s Affordable Housing Plan and COAH’s basis for determination of the implementation of the Growth Share for residential and non-residential projects for the third round and its affect. Burgis mentioned the Third Round Obligation is from January 1, 2004 to 2014.
A discussion followed the presentation; at 8:50 PM Ross thanked Burgis for his time. The draft of the Housing Element and Fair Share Plan will need to go before the Township’s Planning Board by August 2005 and the final draft before the Governing Body for approval by November 2005 in order to meet COAH’s deadline of December 20, 2005.
At 8:55 PM Plicinski made the motion, seconded by Calandrillo, to enter into Closed Session for the purpose of discussing potential litigation. All in favor. Motion carried.
At 9:15 PM Calandrillo made a motion, seconded by Snyder, to return to Open Session. All in favor. Motion carried.
Snyder made the motion, seconded by Calandrillo, for DeScherer to implement, from this day forward, Section IX, 24-14 (c) 2 of the Affordable Housing Plan:
“Low and moderate income sales units approved by the Planning Board prior to January 1, 1997 under 1987 Township of Mahwah Plan shall remain affordable to low and moderate income households for a period of not less than 25 years. All such conveyances shall contain deed restrictions and mortgage liens required by the Township of Mahwah Housing Commission and COAH.”

Being no further business, Calandrillo made a motion for adjournment at 9:20 PM. Snyder seconded. All in favor. Motion carried.
The next scheduled Housing Commission meeting is Tuesday, April 19, 2005 at 7:00 PM.
