TOWNSHIP OF MAHWAH
PUBLIC MEETING MINUTES
THURSDAY, JANUARY 22, 2004

The meeting was called to order at 8:00PM by Council President Richter who read the Open Public Meetings Act Statement as prescribed by law. Notice was faxed to the Editors of Suburban News and The Record on January 15, 2004 stating the meeting of January 15, 2004 was canceled due to inclement weather and this meeting would be held in the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey on Thursday, January 22, 2004 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag.

Present: Councilmembers Calandrillo, DaPuzzo, DiGiulio, Kelly, Paton, Richter and
Spiech.

Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney Menelaos W. Toskos and Municipal Clerk Kathrine Coletta.

APPROVAL OF BILLS AND CLAIMS
On a motion by Calandrillo, seconded by Paton, the Bills and Claims, previously signed, totaling $3,772,431.88, were approved. Roll call vote: Calandrillo, yes; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Spiech, yes; Richter, yes. A list of Bills and Claims is on file in the Municipal Clerk’s Office.

APPROVAL OF MEETING MINUTES
On a motion by Calandrillo, seconded by Paton, the Closed Session Meeting Minutes of October 2, 2003, Closed Session Meeting Minutes of October 30, 2003, Closed Session Meeting Minutes of November 6, 2003, Work Session Meeting Minutes of November 6, 2003, Work Session Meeting Minutes of December 4, 2003, Closed Session #1 Meeting Minutes of December 4, 2003, Closed Session #2 Meeting Minutes of December 4, 2003, Work Session Meeting Minutes of December 11, 2003, Closed Session Meeting Minutes of December 11, 2003, Closed Session Meeting Minutes of December 18, 2003 and the Public Meeting Minutes of December 18, 2003 were approved. All in favor. Motion carried.

REPORT OF TOWNSHIP COUNCIL AND MUNICIPAL CLERK
Calandrillo thanked the Mayor and Council for their condolences on the passing of her Father and Father-in-law.


DaPuzzo attended the January 12, 2004 Planning Board Meeting and advised Council of the various actions taken by the Planning Board.

Kelly attended the Flood Control Meeting on Tuesday.

Paton attended the Chamber of Commerce Luncheon.

Spiech attended the Senior Club Meeting.

Spiech attended the Flood Control Meeting.

Spiech attended the Highlands Commission Meeting at the Police and Fire Academy.

REPORT OF MAYOR AND BUSINESS ADMINISTRATOR
Mayor Martel attended the Chamber of Commerce Breakfast. Dr. Watwey was guest speaker.

Mayor Martel attended Mayors’ Legislative Meeting in Trenton. He stated that State Aid for the Townships and School Boards will remain the same for 2004.

Mayor Martel attended the Highlands Commission Meeting.

Mayor Martel attended the Senior Meeting.

Mayor Martel heard a rumor that he was not going to run for Mayor in May. He said set aside doubts, he plans to run.

PUBLIC PORTION
On a motion by Spiech, seconded by Calandrillo, the meeting was opened to public at 8:19PM. All in favor. Motion carried.

Mr. Drew Baumgardt of 200 Midvale Mountain Road attended the Highlands Meeting, and was glad to see Mahwah represented.

Mr. Allan Kidd of 111 Miller Road asked the status of the investigation on the Property Maintenance Officer. Richter stated it has been investigated and the work hours are the hours he was to be at work.

Mr. Albert Kidd of 851 Darlington Avenue attended the Highlands Meeting. He feels Ramapo College is a big violator and are draining our resources. He asked if Ramapo College is exempt from Property Maintenance Code.

Mr. Kidd complained of Township property, RAIA is in need of repair and the sidewalk in front of Police Station was not shoveled during a recent snow storm.

On a motion by Calandrillo, seconded by Paton, the meeting was closed to the public at 8:43PM. All in favor. Motion carried.

ORDINANCES – INTRODUCTIONS
The title of an Ordinance was read as follows:
BOND ORDINANCE AMENDING BOND ORDINANCE NUMBER 1466 OF THE TOWNSHIP OF MAHWAH, IN THE COUNTY OF BERGEN, NEW JERSEY FINALLY ADOPTED NOVEMBER 13, 2003.

RESOLUTION – ORDINANCE NO. 1473

Introduced by Calandrillo, seconded by Kelly.

RESOLVED that this Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance will be considered for final passage at a meeting to be held on February 12, 2004 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey at 8:00PM.

FURTHER RESOLVED that the Municipal Clerk shall publish said Ordinance with notice of introduction, passage and time and place where said Ordinance will be considered for final passage.

Roll call vote: Calandrillo, yes; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Spiech, no; Richter, yes.

The title of an Ordinance was read as follows:
AN ORDINANCE AUTHORIZING THE TOWNSHIP OF MAHWAH TO ENTER INTO A SIX MONTH LEASE OF PROPERTY LOCATED IN SUFFERN, NEW YORK.

RESOLUTION – ORDINANCE NO. 1474

Introduced by Paton, seconded by Calandrillo.

RESOLVED that this Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance will be considered for final passage at a meeting to be held on February 12, 2004 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey at 8:00PM.

CONSENT AGENDA
Resolutions #005-04 and #007-04 were removed from the Consent Agenda and voted on separately. Resolutions are attached to and made part of these Meeting Minutes.

NEW BUSINESS

COUNCIL COMMENTS/COMMUNICATIONS
Richter attended Chamber of Commerce Business Card Exchange.

Richter received a letter from Mr. Greene regarding Vista Bahn and the Steep Slope Ordinance. Mr. Greene voiced concerns on Vista Bahn and that he is not happy with the development.

Kelly spoke of correspondence received from a resident on Chapel Road. The Business Administrator responded he has spoken to the Board of Health and the Northwest Bergen Utilities Authority. Kelly requested a report from Administration.

DiGiulio was very pleased to see Mayor Kraus’s home is on front of this years calendar.

REPORT OF SUBCOMMITTEES
DiGiulio stated Beautification Meeting is scheduled for February 3, 2004. She said one member met with Seniors to start a Garden Club.

PUBLIC PORTION
On a motion by Calandrillo, seconded by Kelly, the meeting was opened to the public at 9:05PM. All in favor. Motion carried.

Mr. Albert Kidd of 851 Darlington Avenue asked if a dog is on the payroll as he had seen a dog in one of the Township trucks. The Mayor will check.

Mr. Kidd questioned how to proceed with a complaint against the Township for not shoveling their walk in front of the Police Station. The Business Administrator said during inclement weather, the walk was closed.
On a motion by Calandrillo, seconded by Paton, the meeting was closed to the public at 9:07PM. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Kelly, the meeting was adjourned at 9:08PM. All in favor. Motion carried.
