PUBLIC MEETING MINUTES
THURSDAY, DECEMBER 4, 2003
The Public Meeting immediately followed the Work Session Meeting and was called to order at 10:07PM by Council President Richter.
Present: Councilmembers Calandrillo, DaPuzzo, DiGiulio, Kelly, Paton at 10:08PM, Richter and Spiech.
Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney's Associate Nilufer DeScherer and Municipal Clerk Kathrine Coletta.
APPROVAL OF BILLS AND CLAIMS
On a motion by Calandrillo, seconded by DiGiulio, the Bills and Claims, previously signed, totaling $4,756,128.55, were approved. Roll call vote: Calandrillo, yes; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Spiech, yes; Richter, yes. A list of Bills and Claims is on file in the Municipal Clerk's Office.
APPROVAL OF MEETING MINUTES
On a motion by Spiech, seconded by Calandrillo, the Public Meeting Minutes of August 21, 2003 and the Public Meeting Minutes of October 9, 2003 were approved. Roll call vote: Calandrillo, abstained on Public Meting Minutes of August 21, 2003 and yes to Public Meeting Minutes of October 9, 2003; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Spiech, yes; Richter, yes.
REPORT OF TOWNSHIP COUNCIL AND MUNICIPAL CLERK
Calandrillo reported the Beautification SubCommitee met. The first Mahwah Pride Award will be given to Mahwah Sunoco at the December 18, 2003 Public Meeting.
DiGiulio attended the World Series Football Game at Continental Solders Field.
DiGiulio questioned if the letter was sent to COAH. The Township Attorney answered the letter will be sent tomorrow.
Paton said if anyone is interested he taped the football game on Saturday.
Paton reported the Township was successful at the League with the Seniors Rental Resolution. The introduced resolution shall be taken forward to the legislators.
Paton gave an update on the senior citizen's discount for cable television.
Spiech attended the Stormwater seminar.
Spiech attended the Watershed Management Area 3 Meeting.
Richter reported the Mayor, Councilmen DaPuzzo and Paton and herself met with the firm who is interviewing for the new School Superintendent.
REPORT OF MAYOR AND BUSINESS ADMINISTRATOR
Mayor Martel attended the League of Municipalities Convention where the resolution on the senior housing rent increase was discussed. The committee unanimiously voted to proceed.
Mayor Martel reported the Little League Super Bowl was held recently at the Continental Solders Park. The Mayor thanked the Recreation Department for coordinating the event.
The Business Administrator reported the Township is continuing to do well on grant applications.
On a motion by Calandrillo, seconded by DaPuzzo, the meeting was opened to the public at 10:27PM. All in favor. Motion carried.
Mr. Albert Kidd of 851 Darlington Avenue pointed out over 10,000 acres of property in the Township are tax exempt.
Mr. Allan Kidd of 111 Miller Road asked the status of the situation with Mr. Lane. Mr. Kidd urged the Council to review the International Property Maintenance Code of 1998.
On a motion by Calandrillo, seconded by Spiech, the meeting was closed to the public at 10:37PM. All in favor. Motion carried.
ORDINANCES- PUBLIC HEARINGS
The title of an Ordinance was read as follows:
AN ORDINANCE OF THE TOWNSHIP OF MAHWAH PROVIDING FOR AND REGULATING THE USE OF THE LOWER LEVEL OF THE WINTERS BUILDING AND THE MULTIPURPOSE ROOM IN THE MUNICIPAL BUILDING.
On a motion by Calandrillo, seconded by DaPuzzo, the meeting was opened to the public. All in favor. Motion carried.
Mr. Allan Kidd of 111 Miller Road suggested there be a nominal fee for the rooms to be used during the day. Spiech pointed out the rooms are occupied by the Senior Center during the day.
On a motion by Calandrillo, seconded by Paton, the meeting was closed to the public. All in favor. Motion carried.
On a motion by DaPuzzo, seconded by DiGiulio, the following resolution was passed and adopted:
RESOLUTION - ORDINANCE NO. 1470
RESOLVED that the Ordinance be passed and adopted on second reading and the Clerk is authorized to advertise by title only as having been finally adopted, as required by law.

The title of an Ordinance was read as follows:
AN ORDINANCE AMENDING SECTION 24-14 "CONTROLS ON AFFORDABILITY" OF THE MUNICIPAL CODE.
RESOLUTION - ORDINANCE NO. 1471
On a motion by DaPuzzo, seconded by Kelly, the public hearing on Ordinance #1471 was carried to the December 18, 2003 Public Meeting. All in favor. Motion carried.
Resolutions #188-03A through #192-03A, #194-03A through #198-03A and the Raffle Application for Beth Haverim were voted on under the Consent Agenda. Resolutions are attached to and made part of these Meeting Minutes.
Resolution #193-03A was removed from the Agenda.
Resolutions #199-03A and #200-03A were voted on individually and are attached to and made part of these Meeting Minutes.
DaPuzzo recently spoke to the NJDOT regarding the Weigh Station. A Committee Meeting is scheduled for next month. Consideration, at the Committee level, is being given to a new site out of Mahwah.
DiGiulio interjected that she spoke to Mr. Campbell of the NJDEP and due to safety issues the Mahwah site for the weigh station will be changed.
DaPuzzo congratulated the Mahwah Senior Football Team.
Calandrillo asked when the historic window will be installed in the Meeting Room. Administration shall handle.
Calandrillo requested Administration check the temperature in the Meeting Room on the third floor.
DiGiulio questioned when the remaining leaves will be picked up. Administration answered the DPW is in the process.
Paton suggested days, similar to those for recycling, be set up for the pick up of leaves.
Calandrillo suggested a scheduled be made for street sweeping.
REPORTS OF SUBCOMMITTEES
Kelly reported the Transportation SubCommittee will be meeting on December 8, 2003.
Spiech reported the meeting was scheduled with Suffern on Flood Control was not held.
DaPuzzo reported the Recreation SubCommittee met with the Board of Education. The Commodore Perry and High School Fields were discussed. Further information will be distributed to Council.
DiGiulio gave a brief Beautification SubCommittee report.
On a motion by Calandrillo, seconded by DaPuzzo, the meeting was opened to the public at 11:30PM. All in favor. Motion carried.
Being no comments were made from the public, on a motion by Calandrillo, seconded by Kelly, the meeting was closed to the public at 11:31PM. All in favor. Motion carried.
On a motion by Calandrillo, seconded by Spiech, Council went into closed session at 11:32PM for the purposes of discussing: Contract Negotiations; Litigation - Brennan vs. Mahwah, Malone vs. Mahwah, Mahwah III vs. Mahwah and Monthly Litigation Report.
On a motion by Calandrillo, seconded by Kelly, Council came out of closed session at 12:14AM. All in favor. Motion carried.
On a motion by Calandrillo, seconded by Kelly, the meeting was adjourned at 12:15AM. All in favor. Motion carried.
