The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Ridgewood News on December 5, 2003 stating this meeting would be held in room 311 of the Municipal Offices at 475 Corporate Drive, Mahwah, New Jersey on Wednesday, December 10, 2003 at 7:00 PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present: Brotherton, Calandrillo, Martel, Raiz, Ross

Absent: Plicinski, Snyder

Calandrillo made a motion to accept the minutes of the November 13, 2003 Housing Commission, seconded by Brotherton. Motion approved. Raiz abstained due to absence.

Calandrillo made the motion to accept the minutes of the Housing Commission’s Closed Session of November 13, 2003, seconded by Brotherton. Motion approved. Raiz abstained due to absence.


On a motion by Martel, seconded by Brotherton, the meeting was opened to the Public.

No Public in attendance.

Calandrillo moved to close the Public Portion. Martel seconded. Motion carried.


Raiz asked about the Resolution presented to the League of Municipalities requesting NJHMF to amend rules regarding calculation used for yearly rental increases for senior citizens age 62 and over. Martel reported the Resolution was unanimously accepted. Senator McNamara and Assemblyman Russo are also endorsing the proposal.

DeScherer wrote a letter to Lucy Voorhoeve, Executive Director for COAH, on behalf of the Township, addressing the proposed changes to the substantive regulations. The letter was reviewed; Calandrillo would like clarification on item 7a. “N.J.A.C. 5:94-11.2(c) provides that, in implementing the affirmative marketing plan, the municipality “shall be responsible” for providing the counseling services to lower income applicants on subjects such as budgeting, credit issues, mortgage qualification, rental lease requirements, and landlord/tenant law.” It appears the municipality shall be responsible for providing the counseling services. What would be the cost to the Township?

Reed stated, she and Raiz found at the COAH meetings, most affordable housing is contracted to an agency for monitoring and the Municipalities pay for the services. Raiz felt COAH should develop a list of trained personnel with the Township acting as a referral service.

The six page letter is a result of the Affordable Housing Commission and the Township Planner’s review of COAH’s proposed changes to the substantive regulations.

DeScherer also sent a letter to Susan Bass-Levin, Chairperson of NJ Dept. of Community Affairs, requesting a one (1) year extension of the Township’s Substantive Certification from the effective date of the adoption of COAH’s Third Round methodology or such later date as may be provided in the third round of substantive rules as adopted.


Report A Three units have closed since last week. One unit became available for sale and had a full offer within two days.

Report B Violation- 1417 Faulkner Court- Diaz-Klein, DeScherer put owner on a 14 day notice, if a copy of Lease and $500.00 fee is not received by the Affordable Housing Dept. enforcement action will be taken.

Report C No change.

Report E, E-1, E-2 See summarization page- expenditures for 2002, 2003 total $69,669.00 for payroll and necessary legal fees. Present balance is in excess of $600,000.00.

Calandrillo would like DeScherer to prepare a draft of the blanket Resolution, for the January Housing Commission meeting, regarding use of Trust Fund monies allowing the Township to act quickly in the event of a Foreclosure Notice being received on an Affordable unit.

Being no further business, Brotherton made a Motion for adjournment at 7:35 PM. Calandrillo seconded. Motion carried.

Ross wished all a Happy Holiday season.

The next Housing Commission meeting is Tuesday, January 20, 2004 at 8:00 PM.
