Tuesday June 20, 2006



The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law.  Notice was advertised in the Bergen Record on May 25, 2005 stating that the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, June 20, 2006.


Notice of the meeting is posted on the Municipal Bulletin Board and the Municipal Web-site.  The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.


Present Commission Members:        Mr. Brotherton, Mrs. Calandrillo, Mrs. Raiz, Dr. Ross, Mrs. Wiley


Also present, Ms. Nilufer DeScherer, Associate Township Attorney.


Absent Commission Member:          Mayor Martel, Mrs. Snyder



Mrs. Calandrillo made the motion, seconded by Mr. Brotherton to approve the minutes of June 20, 2006 Housing Commission meeting.  All in favor.  Motion approved. 


On a motion by Mrs. Calandrillo, seconded by Mrs. Wiley, the minutes of the June 20,2006 Executive Session were approved.  All in favor.  Motion approved.




Mrs. Calandrillo moved, seconded by Mrs. Wiley, to open the Public Portion of the meeting.  All present agreed.


There being no Public in attendance, Mrs.Calandrillo made the motion, seconded by Mr. Brotherton to close the Public Portion.  All in favor.  Motion approved.




Discussion ensued at the request of Mrs. Raiz regarding a May 24th  letter from the state regarding the third round substantive certification. Ms. DeScherer  gave an overview of the requirements in the letter:

The Township of Mahwah’s required items are actually fewer than some other towns because Mahwah already has a surplus of units and does not need to identify additional properties.  MPO projections are awaiting calculations from Burgis Associates. The town has thirty days to respond. Mr. Burgis has been advised in writing of the deadline Ms. DeScherer advised that the Planning Department must respond to items # 4, 5, 6, 7 Also, a copy of the Master Plan is required. Mr. Burgis is coordinating the response from the Planning Department to these items. In addition, Mr. Burgis will complete items #1, 2, 3and 9. A separate operating manual will be developed for internal use.  We are in the process of appointing a Housing Liason as required BY COAH procedures (item #8).




Report A-Sales/Rentals- Two units are listed for rental.


Report B- Violations/Potential Violations:


735 Pepperidge Court- Listed in the paper again. There were three or four inquires and the response given is that this unit is not registered with us at this time.


Report C- Pending Foreclosures:


                        194 Larch Lane- Going to foreclosure on June 30, 2006. Owner stated to Mrs. Raiz that he needs a minimum of $25,000.00. Dr. Ross recommended that the Township buy the unit to  keep it in the inventory and then resell it to the appropriate certified applicants on the list. Ms. DeScherer will obtain from the sheriff the amount required.


Report D- Current Foreclosure List:


                        389 Poet’s Way- Ms. DeScherer has not received any response to her  letter ofApril 18, 2006 addressed to the Attorney for Ameriquest Mortgage Company.  Further discussion moved to Executive Session

                        914 Thoreau Court- Mrs. Raiz has not heard from the owner.                      

                        Ms. DeScherer will check her files to determine if a Title Search was done  

                        on this unit.     

1409 Faulkner Court-Foreclosure Complaint received from the firm representing GMAC Mortgage Corporation.

                        2010 Hawthorne Lane- Ms.DeScherer reported Court moved the meeting

                        date to May 25, 2006.

2007 Drake Court- The owner had not responded to Raiz’s letter of April 28, 2006.


Report E thru E-3 Affordable Housing Trust Fund – Mrs. Raiz reported the current balance of $1,167,331.84. Development fees collected through April 12, 2006 are



Ms. DeScherer reported the Ordinance increasing the Development fees was approved by the Township Council; it must be published with the twenty day waiting period and then sent onto C.O.A.H. for endorsement.




Ameriquest Mortgage Co.-389 Poet’s Way- Unit has been sold to a company who purchased the lien. Title search should have shown the judgement against the property. Mrs. DeScherer informed the buyer that the Township will purchase the property at a Sheriff’s sale. Attorney DeScherer is waiting for a response from the company which purchased the lien.

2010 Hawthorne Lane-Butler- Scheduled for Sheriff’s sale June 30, 2006. Awaiting court decision.


            Procedure for Sheriff’s Sale- No discussion


Attorney Letters for unit sales – No discussion


735 Pepperidge Road-Wraga –No discussion.





  1. 2137 Isabelle Court- Discussed situation; will revisit after we receive additional information from owner.
  2. 247 Larch Lane- Owner requested a waiver of the $500.00 rental fee because the tenant entered service after four months in the unit. Attny. DeScherer suggests that the fee be reduced to $100.00 because of circumstances and in keeping with Affordable Housing regulations.Unanimously  approved by the Commission. Raiz will notify the landlord of the Commission’ decision.

Ordinances- Ordinances #138 and #141 have been approved by the Town Council. Mrs. Raiz will follow up with Kathy Coletta to make sure official copies are sent to COAH.







a. Dr. Ross stated hat Maryann Reed’s replacement is Dorothy McDonough formerly with the Health Department.






There Being no further business or discussion, Mrs. Wiley made a   motion to adjourn at 7:25 pm, seconded by Mrs. Calandrillo and, approved by all present.


The next scheduled Housing Commission meeting is Tuesday, July 18, 2006 at 7:00 PM.
