HOUSING COMMISSION MEETING
Tuesday, May 16, 2006
The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, May 16, 2006.
Notice of the meeting is posted on the Municipal Bulletin Board and the Municipal Web-site. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.
Present Commission Members: Brotherton, Calandrillo, Raiz, Ross, Snyder, Wiley.
Also present, Nilufer DeScherer, Associate Township Attorney.
Absent Commission Member: Martel
Calandrillo referring to the minutes of April 18th, under the Manager’s Report on page 2, asked if the individual mentioned was married. Reed specifically asked the person who appeared before the Commission, at the April meeting, if she still was a one person household; her reply was in the affirmative.
Brotherton made the motion, seconded by Snyder to approve the minutes of April 18, 2006 Housing Commission meeting. All in favor. Motion approved. Calandrillo abstained due to absence.
On a motion by Brotherton, seconded by Raiz, the minutes of the April 18, 2006 Executive Session were approved. All in favor. Calandrillo abstained. Motion approved.
Calandrillo moved, seconded by Brotherton, to open the Public Portion of the meeting. All present agreed.
There being no Public in attendance, Calandrillo made the motion, seconded by Snyder to close the Public Portion. All in favor. Motion approved.
Raiz sent letters to the owners of the five Affordable units whose names’ appeared on the Township’s Tax Sale Notice of nonpayment of Municipal Liens for Water and Sewer charges. None have responded.
The letter from Reed to the Commission announcing her retirement was discussed.
HOUSING MANAGER’S REPORTS
Report A-Sales/Rentals-Three units are listed for rental. One unit has a sale pending, and one unit has a rental pending.
Report B- Violations/Potential Violations:

194 Larch Lane- See information in meeting packet.
Report D- Current Foreclosure List:
389 Poet’s Way-DeScherer has not received any response to her letter of
April 18, 2006 addressed to the Attorney for Ameriquest Mortgage Company. Further discussion moved to Executive Session
914 Thoreau Court-Reed has not heard from the owner. DeScherer will
check her files to determine if a Title Search was done on this unit.
1409 Faulkner Court-Foreclosure Complaint received from the firm representing GMAC Mortgage Corporation.
2010 Hawthorne Lane-DeScherer reported Court moved the meeting
date to May 25, 2006.
2007 Drake Court- The owner had not responded to Raiz’s letter of April 28, 2006.
Report E thru E-3 Affordable Housing Trust Fund – Reed reported the current balance of $1,167,331.84. Development fees collected through April 12, 2006 are
DeScherer reported the Ordinance increasing the Development fees was approved by the Township Council; it must be published with the twenty day waiting period and then sent onto C.O.A.H. for endorsement.

b. 2137 Isabelle Court-Moved to Executive Session
At 7:15 pm, Snyder moved that the Housing Commission consult in private with its Attorney concerning the Commission’s Legal rights and duties in reference to specific matters; the exact discussion will not be disclosed. However, any action to be taken by the Commission as a result of said conference shall be taken in public. Seconded by Brotherton and, approved by all present.
Ross stated the items for discussion concern the units located at 389 Poet’s Way/Ameriquest Mortgage Company and 2137 Isabelle Court.
At 7:20 pm, Calandrillo made the motion seconded by Wiley to return to Open Session. All in favor. Motion approved.
Brotherton moved for Counsel to seek the aide of the Court, for enforcement of the Court’s 2003 Summary Judgment Order against Ameriquest regarding 389 Poet’s Way. Seconded by Calandrillo.
Roll Call: yes-Brotherton, yes-Calandrillo, yes- Raiz, yes-Ross, yes-Snyder,
DeScherer will respond to GMAC Mortgage Corporation addressing the Foreclosure Complaint of 1409 Faulkner Court notifying the Mortgage Corp. of the Township’s desire to preserve the Affordable Housing units.
Calandrillo, Council Liaison to the Commission, read the following and requested it to be part of the May Minutes:

“When I first learned that you were retiring at the end of this month, my first thoughts were, ‘Another is joining the ranks of retirement. You go, girl! You are really going to enjoy yourself!’
But before you go, I want you to know that I have enjoyed my association with you these past twelve years while I was a member of the Township Council and as Council Liaison to the Housing Commission. I admired your approach to your responsibilities, the way you handled each case with utmost integrity, dignity, confidentiality, and professionalism. You truly earned the title, “Effective Detective.”
I thank you for your years of service to the Township, and you will be dearly missed. More importantly, I thank you for your friendship. I wish you the best as you approach a new chapter in your life’s book called “retirement.” I am sure it will be a time of creating new memories with your grandchildren. I hope that the only “meeting” schedule you keep will be to enjoy the company of family and friends over lunch!
The Commission presented Reed with a beautiful bouquet of flowers. Reed thanked the Commission for their thoughtfulness and their continued support over the years.
There being no further business or discussion, Snyder made a motion to adjourn at 7:25 pm, seconded by Wiley and, approved by all present.
The next scheduled Housing Commission meeting is Tuesday, June 20, 2006 at 7:00 PM.
