Tuesday, April 18, 2006

The meeting was called to order at 7:00 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, April 18, 2006.

Notice of the meeting is posted on the Municipal Bulletin Board and the Municipal Web-site. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.

Present Commission Members: Brotherton, Raiz, Ross, Snyder and Wiley.

Also present, Nilufer DeScherer, (7:20 PM) Associate Township Attorney.

Absent Commission Members: Calandrillo and Martel.

Wiley made the motion, seconded by Snyder to approve the minutes of March 21, 2006 Housing Commission meeting. All in favor. Motion approved. Brotherton abstained.

On a motion by Wiley, seconded by Raiz, the minutes of the March 21, 2006 Executive Session were approved. All in favor. Motion approved. Brotherton abstained.


At 7:05 pm Brotherton moved, seconded by Snyder, to open the Public Portion of the meeting. All present agreed.

There being no Public in attendance, Brotherton made the motion, seconded by Wiley to close the Public Portion. All in favor. Motion approved.


Reed reviewed the letter from Louis Barbuto, Property Manager of Norfolk Village regarding the 2006 rental increase which is 4.7%. There was no rental increase in 2005. The C.O.A.H. income guidelines for 2006 and 2005 realized an increase of 4% for each year.

Raiz wrote a letter to the owner of 543 Holly Court regarding Affordable Housing Rules and Regulations on refinancing; which does not allow a unit to be encumbered for more than 95% of the Maximum Permitted Price.


Report A- Sales/Rentals-We have received many inquires on the two units listed for rent, with households expressing a desire to apply for Affordable Housing. Another unit has a rental pending with a May 1, 2006 occupancy date.

Report B –Violations/Potential Violations- See information in packet.

Report C – Pending Foreclosures- No changes.

Report D – Current Foreclosures:

389 Poet’s Way- DeScherer requested the Maximum Permitted Sales price for
the unit.
914 Thoreau Court- Owner contacted Reed, stating all outstanding issues have
been paid and he is considering renting the unit.
1409 Faulkner Court-A Certified letter sent to the owner was returned
unclaimed. Raiz spoke to the Management Co. which has put a Lien on the unit
for unpaid Association dues.
2010 Hawthorne Lane – A Case Management was held in Superior Court,
Chancery Division in Hackensack; Discovery is to be submitted by April 23,
2077 Drake Court-The Certified letter sent to the owner was returned unclaimed.
The Management Co. informed Raiz the Association dues for this unit are current and paid through December 2006.

Report E thru E-3 Affordable Housing Trust Fund – Reed reported the current balance of $1,154,339.89.

At 7:15 pm, Wiley moved to open the meeting to the Public. Brotherton seconded. Motion approved.

Danielle D’Ercole addressed the Commission regarding the list of Income Eligible Certified Households. Reed explained how the list is adhered to and how the system works. The individual’s standing remains a one person household.

Elaine Buccisano-Wraga, owner of 735 Pepperidge Road spoke to the Commission, requesting a status update. Raiz explained the Commission voted in February and notified Ms. Wraga, that until the fees which remain in arrears are paid, the Housing Dept. is unable to honor her request.

At 7:30 pm, Snyder moved to close the Public Portion, seconded by Brotherton and, approved by all present.


a. Ameriquest Mortgage Co. – 389 Poet’s Way- DeScherer wrote a letter
to Richard Haber, Esq., Attorney for Ameriquest; requesting a Sheriff’s Sale be scheduled by May 15, 2006 or the Township will seek the aid of the Court in enforcing the 2003 Order and 2004 Stipulation of Settlement.
Raiz expressed concern regarding the possible Legal fees which may occur, in addition, to the past fees. Further discussion moved to Executive Session. The Commission will also revisit the issue at the next meeting scheduled for May 16, 2006.
b. Butler -2010 Hawthorne Ln. See above under Report D. Discussion moved to Executive Session.
c. Procedure for Sheriff’s Sale- DeScherer has tried to contact the Attorney
for the County in charge of the Foreclosure’s for the Sheriff’s Sales.
d. Attorney Letters for unit sales- DeScherer has a letter draft and will review it with Raiz.
e. 735 Pepperidge Road-Wraga- See above-Public Portion.
f. 247 Larch Lane-Harrington- DeScherer spoke with the owner after contacting C.O.A.H., stating if the unit can not be rented, it can be sold.

At 7:35 pm, Snyder moved that the Housing Commission consult in private with its Attorney concerning the Commission’s Legal rights and duties in reference to specific matters; the exact discussion will not be disclosed. However, any action to be taken by the Commission as a result of said conference shall be taken in public. Brotherton seconded.

At 7:50 pm, Wiley made the motion seconded by Snyder to return to Open Session. All in favor. Motion carried.

Raiz reported on information received from the New Jersey Human Relation Council regarding the first Northern Region Housing Hearing scheduled for Sunday, April 30, 2006 from 5:00 pm to 7:00 pm at the Bergen County Administration Building in Hackensack. Due to the late notice of the meeting, and prior commitments no one from the Commission or Housing Department will be able to attend.

There being no further business or discussion, Wiley made a motion to adjourn at 7:55 pm, seconded by Brotherton and, approved by all present.

The next scheduled Housing Commission meeting is Tuesday, May 16, 2006 at 7:00 PM.
