Tuesday, March 21, 2006

The meeting was called to order at 7:05 PM by Chairman, Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Bergen Record on May 25, 2005 stating the meeting would be held in room 311 of the Municipal Building located at 475 Corporate Drive, Mahwah, New Jersey on Tuesday March 21, 2006.

Notice of the meeting is posted on the Municipal Board and the Municipal Web-site. The minutes of the meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web-site upon adoption by the Commission.

Present Commission Members: Calandrillo, Martel, Raiz, Ross, Snyder and Wiley.

Also present, Nilufer DeScherer, (7:15 PM) Associate Township Attorney.

Absent Commission Member: Brotherton

Moved by Snyder, seconded by Calandrillo, agreed by all present, the minutes of February 21, 2006 Housing Commission meeting were approved.

Calandrillo made the motion, seconded by Snyder to approve the minutes of February 21, 2006 Executive Session. All in favor. Motion approved.


At 7:10 PM Snyder moved, seconded by Calandrillo, to open the Public Portion of the meeting. All present agreed.

Elaine Buccisano – Wraga, owner of the Affordable unit located at 735 Pepperidge Road addressed the Commission.

De Scherer reminded Ms. Wraga; Judge Rosa of Special Civil Court dismissed her Claim against the Township without Prejudice in an earlier hearing at which De Scherer represented the Township.

At 7:35 PM the discussion with Ms. Wraga was tabled, the Housing Commission will request a copy of Judge Mc Geady’s decision from Atty. Samson, Prosecutor for the case held in Bergen Count Municipal Court on June 3, 2005, Township of Mahwah vs. Elaine L. Buccisano-Wraga.

However, the Housing Commission’s position is that the monies are still due and payable prior to moving forward with the owner’s request. The issue will be revisited at the April 18, 2006 Housing Commission meeting.

Elizabeth Harrington, 247 Larch Lane, spoke to the Commission regarding her Affordable unit. De Scherer will contact COAH in attempt to determine if there is any type of waiver provision available.

At 7:50 PM Calandrillo made the motion, seconded by Snyder to close the Public Portion. All in favor. Motion approved.


Raiz discussed the inquiry from Kevin Cooke, the Attorney for Ridge Gardens Home Owner’s Association.


Report A – Sales/Rentals - Three (3) units remain available for rent.

Report B – Violations/Potential Violations

735 Pepperidge Road – Wraga – See above.

Report C – Pending Foreclosures – No changes

Report D – Current Foreclosures –

389 Poet’s Way – De Scherer did not have time to follow up on the situation.
She has not heard back from Ameriquest’s Atty. However, she has drafted a very
detailed letter and will attach a copy of the Order of Summary Judgment, as well
as, the signed Stipulation of Settlement and will forward the items to Mr. Haber.

914 Thoreau Court – No changes

1409 Faulkner Court – Certified letter to owner was returned – unclaimed.

2010 Hawthorne Lane – DeScherer reported the Township’s Motion to
Intervene was granted.

2077 Drake Court – Certified letter to owner was returned – unclaimed.

Report E thru E-3 Affordable Housing trust Fund –Balance is $1,137,549.89; 2006 Development Fees collected as of March 16, 2006 are $43,849.81.

c. Procedure for Sheriff’s Sale- DeScherer will contact County Attorney
d. Power of Attorney Letter – DeScherer’s will have her office fax the information to the Affordable Housing Dept. tomorrow morning.
e. Attorney Letters for unit sales – DeScherer will follow up
f. 735 Pepperidge Road – Wraga – See above under Public Portion

At 8:15 pm, Snyder moved that the Housing Commission consult in private with its Attorney concerning the Commission’s Legal rights and duties in reference to specific matters; the exact discussion will not be disclosed. However, any action to be taken by the Commission as a result of said conference shall be taken in public. Calandrillo seconded.

DeScherer stated the Butler issue will be discussed.

At 8:17 pm., Calandrillo made the motion, seconded by Wiley to return to Open Session. All in favor. Morion carried.

There being no further business or discussion, Calandrillo made a motion to adjourn at 8:20 pm., seconded by Snyder and, approved by all present.

The next scheduled Housing Commission meeting is Tuesday, April 18, 2006 at 7:00 PM
