MINUTES

FEBRUARY 27, 2006

6:45 P.M. SUB-REVIEW COMMITTEE MEETING

1. OPENING STATEMENT

The combined public/work session meeting of the Planning Board of the Township of Mahwah held at the Municipal Building, 475 Corporate Drive, Mahwah, N. J. was called to order at 7:00 p.m. by Dr. Ross, Chairman. The Opening Statement was read according to the Sunshine Law followed by the flag salute and roll call.

These minutes are a synopsis of the meeting. A verbatim audio tape recording is on file with the Board Secretary at the Planning Board Office, 475 Corporate Dr., Mahwah, N.J. Copies of the tapes may be purchased for a fee.

PRESENT: Mr. Brotherton, Mr. DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Donigian, Mr. Rudolph, Mr. Sherer.

ABSENT: Ms. Richter, Mr. Jandris

PROFESSIONALS: Peter J. Scandariato, Esq., Mike Kelly, P.E., Bridgette Bogart, P.P.

II. APPROVAL OF BILLS

1/13/06 Harwood Lloyd $894.49

A motion to approve the bills was made by Mr. Rudolph and seconded by Mr. Trent and seconded by Mr. DaPuzzo. All voted in favor.

III. APPROVAL OF MINUTES

No minutes were presented.

IV. MEMORIALIZING RESOLUTION

A motion to approve was made by Mr. Trent and seconded by Mr. Rudolph. A roll call of eligible members revealed 8 aye votes by Mr. Brotherton, Mr. DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Rudolph and Mr. Sherer. Mayor Martel abstained from voting on Dkt. #405-S.

V. OPEN TO THE PUBLIC

A motion to open the meeting to the Public was made by Mr. Rudolph and seconded by Mr. Trent. All voted in favor.

A motion to close was made by Mr. DaPuzzo and seconded by Mr. Crean. All voted in favor.

VI. PUBLIC HEARINGS

A. DKT. #493 – FRASCO HOMES, INC., 27 BEVERIDGE RD.

Notices were in order.

Bruce Whitaker, Attorney for the Applicant appeared before the Board.

The application is for a minor subdivision. The application is for Block 89, Lots 13, 14, 15, 66 & 74 in the R15 Zone. The applicant is requesting a small subdivision line to be established on Block 89, Lot 13 (Robert & Diane Homler). The applicant is proposing to create one lot that will be conforming and will reduce one lot in size. This lot will be less than what is required. Mr. Whitaker stated that he will provide testimony that the size of the lot is still in keeping with the character of the neighborhood.

Mr. Whitaker stated that with the creation of the oversized lot, this lot would not be permitted by deed restriction to have another subdivision that would create another full building lot on this property. Mr. Whitaker also stated that upon completion of the single family home, there would be no access to Mahwah Road from this property.

Matthew Frasco, 12 Fox Run Rd., Allendale was sworn in. He is the contract purchaser of a portion of lot 13. The plans submitted with this application which is shown as

proposed lot 14 is subject to a contract of sale with the owner (Mrs. McCutcheon). The proposed home is to be a single family colonial style home consisting of approximately 4,000 sq. ft.

Mr. Frasco stated that the requests from the Historic Site Committee and the requests for information concerning sewer and septic can be met and provided for.

In answer to Mayor Martel’s question, Mike Kelly indicated that Lots 67 and 68 are non-conforming lots.

A motion to open the meeting to the Public was made by Mayor Martel and seconded by Mr. Rudolph. All voted in favor.

John Musinski, 215 Mahwah Rd., owner of lots 67 & 68 appeared before the Board. He questioned lot 13 being non-conforming.

A motion to close was made by Mr. Rudolph and seconded by Mr. Donigian. All voted in favor.

Mark Palus, P.E., P.P., 107 Kinnelon Rd., Kinnelon, N. J. was sworn in. Mr. Palus stated his credential and was accepted as an expert witness.

The Minor Subdivision (page 1) and Topographic Survey (page 2) was marked “A-1” and the colorized version dated 10/22/05 was marked as “A-2”.

Mr. Palus described the existing site and described Lot 74 as having 84,513 sq. ft. which is significantly oversized for the zone. Mr. Palus stated the homes in the area which were built in the late 60’s, early 70’s were in the R-10 zone. After the completion of these homes the zone was changed to R-15 making the lots surrounding lot 13 non-conforming.

Mr. Palus referred to Page 2 of “A-1”describing the proposed subdivision lot lines. Mr. Palus stated that the 788 sq. ft. parcel on Lot 13 will be annexed to Lot 14 allowing access to Orchard Dr. Lot 14 will be 63,882 sq. ft. and will be fully conforming in nature, Lot 74 will then be 17,119 sq. feet and Lot 13 will be reduced to 10,618 sq. ft.

Mike Kelly commented on Lot 14 stating that it is not entirely variance free. They do not have the required 67.5 ft. lot frontage off Orchard Dr.

Mike Kelly stated that the stone buildings on proposed lot 74 are to be considered accessory structures. It should be noted that they are existing structures. They will not meet the required side yard and rear yard setback. Mr. Kelly also stated that the shed on Lot 13 does not meet the required 5 ft. setback. However, this is an existing condition.

Mr. Whitaker indicated that the accessory structures are old stone buildings and because of the nature and character of them they would ask that they remain there. The Historic Sites Committee is also in agreement. Mr. Whitaker presented photos of the buildings which were marked “A-3”.

The Board requested the applicant revise the plans to show how many lots could be created on lot 14.

A motion to open to the Public was made by Mr. Brotherton and seconded by Mr. Trent. All voted in favor.

Toni Wong, 215 Orchard Dr. appeared before the Board. She had a question regarding the ability of a fire engine be able to maneuver in the circular drive on lot 15.

A motion to close was made by Mr. Trent and seconded by Mr. DaPuzzo. All voted in favor.

A motion to open to the Public for comments or questions was made by Mr. DaPuzzo and seconded by Mr. Rudolph. All voted in favor.

John Muisinski, 215 Mahwah Rd. was sworn in. He was concerned about the number of houses that could be built.

Barbara Altamona, 225 Orchard Dr. was sworn in. She stated that there is very low water pressure in the area and was concerned about having another home built in the area.

Toni Wong, 215 Orchard Dr. was sworn in. She also complained about the water pressure. Mr. Whitaker stated that if there is a problem with the construction of the water line off of Orchard, he was advised that there is a water main line that can be tapped into on Mahwah Rd.

Linda Muisinski, 215 Mahwah Rd. was sworn in. She also commented on the water pressure.

Mr. DaPuzzo stated that the Town is trying to address this problem.

Patti Galal, 213 Mahwah Rd. was sworn in. She stated there is a beautiful stone wall behind her lot and asked if it could remain. Dr. Ross stated it will remain.

Barbara Osocarriage, 20 Laurel Ct. She wanted confirmation that there would be no further building on Lot 14. Dr. Ross stated there will be no future subdivision on this lot.

A motion to close the meeting to the Public was made by Mr. Rudolph and seconded by Mr. Donigian. All voted in favor.

After some discussion and concerns regarding the amount of homes that could be built on lot 14, Mike Kelly stated that if they came in off of Beveridge Rd. there could be a possibility of creating 3 buildable lots. There is a possibility of creating a fourth lot but this would require obtaining additional land and creating variances.

There was a motion to approve with the following conditions: There shall be no further subdivisions of lot 14; limitation on size of house being 4,000 sq. ft. plus the basement; elimination of any access on the 25 ft. strip to Mahwah Rd., approval of 2 variances on lot 13; 1 variance on lot 14, rock walls to he used on site. A motion was made by Mr. Brotherton and seconded by Mr. Donigian. A roll call revealed 9 aye votes by Mr. Brotherton, Mr. DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Donigian, Mr. Rudolph and Mr. Sherer.

VII. WORK SESSION:

A. DKT. #467 – MAHWAY/GREENWAY, L.L.C. – 14 GREENE ST.

Mr. Rudolph recused himself.

Eric Koskinen, Vice President of Greenway Development Co. appeared before the Board.

The applicant is requesting an elevation change from the original approval due to the fact that during the course of construction they encountered ground water. Mr. Koskinen stated that the difference in the elevation is 1.73 feet.

Mike Kelly indicated that the ordinance states that the building floor elevations cannot be changed by more than 1.5 feet. He stated he takes no exception with regard to the building height, 35 ft. is permitted and they will be below 30 ft.

A motion to approve was made by Mr. Donigian and seconded by Mr. Trent. A roll call revealed 8 aye votes by Mr. Brotherton, Mr DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Donigian, Mr. Sherer.

B. E-BD-216-1911 – RON & KATHY KNIGHT, 4 BROOK COURT

Ron Knight, 4 Brook Court appeared before the Board. He is requesting permission to retain the single family home during construction of the new home. The existing house will be demolished upon completion of the new one.

Mr. Scandariato stated that the applicant shall be permitted to use the existing dwelling during construction of the new dwelling. The existing dwelling must be demolished, fill or remove the existing septic system (if applicable) and regrade the subject property within 60 days following the issuance of the certificate of occupancy for the new dwelling. The performance guarantee posted by the applicant shall not be released until the applicant has applied with these conditions.

Mr. Knight agreed to these terms.

A motion to approve was made by Mr. DaPuzzo and seconded by Mr. Crean. A roll call of members present revealed 9 aye votes by Mr. Brotherton, Mr. DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Donigian, Mr. Rudolph and Mr. Sherer.

C. COMMITTEE REPORTS

1. TA06-2006 – GRACIE OF MAHWAH, 107 MILLER RD.

A motion to approve was made by Mr. Rudolph and seconded by Mr. Brotherton. A roll call revealed 9 aye votes by Mr. Brotherton, Mr. DaPuzzo, Mayor Martel, Dr. Ross, Mr. Trent, Mr. Crean, Mr. Donigian, Mr. Rudolph and Mr. Sherer.

D. OLD/NEW BUSINESS

There was a discussion regarding the rezoning request for Block 21-23 and 24 (partial).
The Board members felt they needed more information before an informal recommendation could be made. Ms. Winokur will request a report from Mr. Burgis for the Board’s review.

VIII. ADJOURNMENT.

Mr. DaPuzzo made a motion to adjourn. All voted in favor. Meeting was adjourned at 9:00 p.m.
