TOWNSHIP OF MAHWAH
PUBLIC MEETING MINUTES
THURSDAY, APRIL 14, 2005

The meeting was called to order at 8:00PM by Council President Richter who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record On July 6, 2004 and August 16, 2004 stating this meeting would be held in the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey on Thursday, April 14, 2005 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag.

Present: Councilmembers Alderisio, DiGiulio, Kelly, Paton, Richter and Roth.
Absent: Councilwoman Calandrillo

Also present were Business Administrator Brian Campion, Township Attorney’s Associate Nilufer DeScherer and Municipal Clerk Kathrine G. Coletta.


PRESENTATION TO RAMSEY OUTDOOR STORES
Mr. Drew Baumgardt, Recreation Director, introduced Mr. Stuart Levine, President of the Ramsey Outdoor Stores and Mr. Rob Fisher, the Water Sports Manager of Ramsey Outdoor Stores who sponsored the Township’s “Paddle Day’s.” The Recreation Committee and Council joined together to thank and presented Mr. Levine and Mr. Fisher with plaques for their efforts with regard to the Township.

APPROVAL OF BILLS AND CLAIMS
On a motion by Paton, seconded by Kelly, the Bills and Claims, previously signed, totaling $4,953,390.97, were approved. Roll call vote: Alderisio, yes; Calandrillo, absent; DiGiulio, yes; Kelly, yes; Paton, yes; Roth, yes; Richter, yes. A List of Bills and Claims is on file in the Municipal Clerk’s Office.

APPROVAL OF MEETING MINUTES
On a motion by Roth, seconded by Alderisio, the Budget Work Session Meeting Minutes of February 12, 2005 and Budget Work Session Meeting Minutes of February 15, 2005 were approved. All in favor. Motion carried.

On a motion by Paton, seconded by Roth, the Amended Budget Work Session Meeting Minutes of March 15, 2005 were approved. Roll call vote: Alderisio, yes; Calandrillo, absent; DiGiulio, yes; Kelly, abstain; Paton, yes; Roth, yes; Richter, yes.

REPORT OF TOWNSHIP COUNCIL and MUNICIPAL CLERK
DiGiulio attended the dedication of the Bradley Recreation Center at Ramapo College of New Jersey. DiGiulio stated it was a beautiful opening and she congratulated Senator Bradley.

Ramapo College of New Jersey. Kelly stated it was nice to see the Governor in attendance. Kelly said he had the opportunity to meet the new President of Ramapo College of New Jersey and relayed that the new President would like to meet with Council at a future date.

Kelly stated at the Planning Board there was an issue that upset residents: The Russo Property on MacArthur Boulevard and North Central Avenue. Kelly stated there were some miscommunications, and the property being cleared of trees did involve some violations that are being looked into. Residents have since realized that the buffer is still in tact, and the Owner is willing to work with the residents to replace some trees.

Paton attended the High School and Middle School Expansion Opening and Award Ceremony. Paton commented that the Board of Education is hoping the School Budget will pass.

REPORT OF MAYOR and BUSINESS ADMINISTRATOR
No report.

MAYOR’S PROCLAMATIONS
Due to the Mayor’s absence, Council President Richter read the following two Proclamations: National Volunteer Week - April 17 through 23, 2005 and Community Transportation Services Week - April 17 through 23, 2005.

PUBLIC PORTION
On a motion by Kelly, seconded by Roth, the meeting was opened to the public at 8:27PM. All in favor. Motion carried.

Mr. Allan Kidd of 111 Miller Road complained about the microphone which the public uses was not working properly.

Mr. Albert Kidd of 851 Darlington Avenue feels the four Councilmembers who voted to adopt the Budget should be ashamed. Mr. Kidd feels Council should take responsibility for the spending.

Mr. Bill Romano of 204 Stephens Lane feels that the Council is taking a more “lavished” approach to spending money.

On a motion by Kelly, seconded by Roth, the meeting was closed to the public at 8:45PM. All in favor. Motion carried.

ORDINANCES – INTRODUCTIONS
The title of an Ordinance was read as follows:
AN ORDINANCE TO AMEND CHAPTER FIVE OF THE MUNICIPAL CODE TO
PROVIDE FOR THE CURBING OF ALL PETS AND TO PROHIBIT FEEDING OF
WILDLIFE ON PUBLIC PROPERTY.

Introduced by Roth, seconded by Kelly.

RESOLVED that the Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be
held on April 28, 2005 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey at
8:00PM.

FURTHER RESOLVED that the Clerk shall publish said Ordinance with notice of
introduction, passage and time and place where said Ordinance will be considered for final
passage.

SECTION ENTITLED “STORMWATER MANAGEMENT”.

Introduced by Roth, seconded by Kelly.

RESOLVED that the Ordinance be passed and adopted on first reading.

FURTHER RESOLVED that said Ordinance be considered for final passage at a meeting to be
held on April 28, 2005 at the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey at
8:00PM.

CONSENT AGENDA
Resolutions #083-05 through #085-05, #087-05 through #090-05, #093-05, #094-05 and the
Raffle Application for St. Catherine of Bologna School were approved. Resolutions are attached
to and made part of these Meeting Minutes.

Resolutions #086-05 and #091-05 were voted on separately and are attached to and made part of these Meeting Minutes.

Resolution #092-05 was removed from the Agenda and carried to April 21, 2005.

PUBLIC PORTION
On a motion by Paton, seconded by Roth, the meeting was opened to the public at 9:20PM. All in favor. Motion carried.

Mr. Allan Kidd of 111 Miller Road asked how much money was spent to “rubber stamp” the Bills and Claims.

Mr. Albert Kidd of 851 Darlington Avenue referred to the Legal Section of The Record where many residents are having their homes foreclosed upon.

Mr. Kidd questioned the Outside Sales Ordinance.

On a motion by Roth, seconded by Paton, the meeting was closed to the public at 9:38PM. All in favor. Motion carried.

CLOSED SESSION
On a motion by DiGiulio, seconded by Roth, Council went into closed session at 9:40PM for the purpose of discussing Grievance; DPW Employee. All in favor. Motion carried.

Richter reported that as a result of Closed Session, a Resolution shall be prepared for the April 21, 2005 Work Session Meeting.

On a motion by Roth, seconded by Paton, the meeting was adjourned at 10:09PM. All in favor. Motion carried.
