TOWNSHIP OF MAHWAH
WORK SESSION MEETING MINUTES
THURSDAY, FEBRUARY 3, 2005

The meeting was called to order at 8:00PM by Council Vice President Kelly who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record on July 6, 2004 and August 16, 2004 stating this meeting would be held in the Municipal Offices, 475 Corporate Drive, Mahwah, New Jersey on Thursday, February 3, 2005 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag.

Present: Councilmembers Alderisio, Calandrillo, Kelly, Paton and Roth
Absent: Councilmembers DiGiulio and Richter

Also present were Business Administrator Brian Campion, Township Attorney Meneloas Toskos, Township Attorney’s Associate Craig Bossong, Township Engineer’s Associate Michael Kelly, Township Utility Engineer Justin Mahon, Township Utility Engineer’s Associate Vishal Shah and Municipal Clerk Kathrine Coletta.


PUBLIC PORTION
On a motion by Calandrillo, seconded by Alderisio, the meeting was opened to the public at 8:03PM. All in favor. Motion carried.

Mr. Frank Russo of 22 Olney Road pointed out the Township has not had a tax increase in 12 years and this year the taxes will be increased 18 per cent. Mr. Russo feels someone should stand up for the Taxpayers.

Ms. Ellen Stein, President of CAM spoke about the transfer of the Green Acres Funds. She is of the understanding there is a process. She questioned whether this is something which Administration wants to see happen. The Business Administrator answer the Mayor and himself are 100 per cent in favor of the Diversion Application. Ms. Stein asked the Council Vice President of the Council is of the same feeling as the Mayor and Administrator. The Council President answered yes on behalf of the Council. Ms. Stein expressed concern that the Legislators were not given the Application.

Ms. Stein requested a Resolution be considered this evening and tomorrow provided to the legislators and Acting Governor stating the Township’s position.

Mr. Allan Kidd of 111 Miller Road feels with the Airmont Transfer if the Township is going to take action to be sure to get the legislators on board.

Mr. Kidd feels that all of the Budgets are inconsistent.

Mr. Kidd expressed concern over the Property Maintenance Officer removing “For Sale” signs.

Mr. Kidd feels the Ordinance SubCommittee should look at the Ordinance.

Mr. Kidd spoke about the Soil Movement Ordinance and the requirement for a permit if a new driveway is installed.

Mr. Kidd questioned the Outside Sales Ordinance.

Mr. Albert Kidd of 851 Darlington Avenue questioned the cost for the Police Officer to be in the Council Chambers.

Mr. Kidd questioned how many vehicles the Township owns and of those vehicles how many of them are taken home by the individuals.

Mr. Peter Cassotis of 107 South Mahwah Road questioned of the proposed Budget how much is due to mandates.

Mr. Cassotis pointed out that surrounding towns spend more money on Recreation Programs than the Township.

On a motion by Alderisio, seconded by Paton, the meeting was closed to the public at 8:20PM. All in favor. Motion carried.

SUBMISSION OF BILLS AND CLAIMS
Any Councilmember which questions on the Bills and Claims was asked to contact Administration prior to the February 10, 2005 Public Meeting.

ENGINEERING (Boswell-McClave)
1a. Russo Development; MacArthur Boulevard and North Central Avenue; Block 139 Lot 4; Authorization to Execute Developer’s Agreement (Dkt. #462)
Item was carried.

1b. Written Status Report
MA-281: Willowbank Court Stream Cleaning
The Township Engineer’s Associate stated he would be meeting with the County on Tuesday to
review the course of action to be taken for the Willowbank Court Stream Cleaning. The Township
Engineer’s Associate stated he would keep the residents informed.

MA-761: 2004 Curb and Sidewalk Program
The Township Engineer’s Associate stated he would be receiving bids on this on February 11, 2005.

MA-786: Young World Day School
The Township Engineer’s Associate stated he would be reviewing this with the neighbors in the
area, the Police Department, and members of the Young World Day School at the February 17, 2005

Paton asked if the Public School Bus Administration could also be briefed on the Young World Day
School Project progress. Alderisio asked for a County Representative to be present as well. The
Township Engineer’s Associate said he would extend an invitation. Kelly stated the Municipal
Clerk already extended this invitation.

MA-700: Municipal Stormwater Regulation Plan
Roth asked for an update on the Municipal Stormwater Management Regulation Plan. The Township Engineer’s Associate stated this Document would be brought to Council on March 1, 2005 Council Meeting, and it will subsequently be sent to the County for review prior to submission to the State on April 1, 2005. The Township Attorney stated the Ordinances will be available for review during the next Work Session.

MA-107: Bike Path Program (Resolution No. 144-00)
Paton asked what the status was on the Bike Path Program. Township Engineer’s Associate anticipates this project to be completed by March 15, 2005.

MA-761: 2004 Curb and Sidewalk Program
Paton stated there was a request by the residents in the neighborhood of Betsy Ross School that
the sidewalk on Malcolm Road be extended to Mahwah Road. Township Engineer’s Associate will take this to Administration for their consideration, and he will know more after receiving bids by February 11, 2005.

Paton brought up problems with the Suzuki Dealership on Franklin Turnpike and asked about the validity of the Zoning for this Car Dealership. Paton asked for a report from Administration on this property and to find out if this property is currently in a Zoning violation. Township Engineer’s Associate stated he could prepare a summary on this for Council. The Business Administrator state this request should be turned over to the Township Attorney for review.
Kelly requested the report be provided no later then February 17, 2005.

MA-632: U.S. Corps of Engineers Flood Control Project
Calandrillo asked about the status on the meeting with the U.S. Corps of Engineers regarding the Flood Control Project. The Township Engineer’s Associate stated the meeting needed to be rescheduled for the beginning of March.

MA-220: Franklin Turnpike/Miller Road and East Ramapo Avenue – Intersection Improvements (Resolution No. 148-01)
Kelly asked if the additional Topographical Survey would delay the timing of this project. The Township Engineer’s Associate said yes. Kelly asked to have this project move along in a more timely fashion.

MA-281: Willowbank Court Stream Cleaning
Kelly asked the Township Engineer’s Associate for a copy of the schedule for the Willowbank Court Stream Cleaning.

MA-457: Municipal Complex – Construction Engineering and Inspection Services
Kelly asked the Township Attorney for an update. The Township Attorney stated this issue was settled. Kelly asked for a copy of the Punch List for Council.

MA-618: Cragmere Drainage Study
Kelly asked about potential funding for this project. The Township Engineer’s Associate stated he has reviewed the potential funding sources and it appears that there will be funding available. The Township Engineer’s Associate will let Council know when the Applications are ready for submission.

MA-759: Installation of Salt Shed on Micik Lane
Kelly asked if the Salt Pile that we currently have is covered. The Business Administrator said yes.

MA-257: Wyckoff Avenue and Forest Road Intersection (Resolution No. 177-00)
Paton stated there was to be a follow up meeting with regards to the Wyckoff Avenue and Forest Road Intersection, and he wanted to know when this would be scheduled. The Township Engineer’s Associate stated he is in the process of setting this meeting up and would let Council know as soon as the plans have been made.

UTILITY ENGINEER (Malcolm Pirnie)
2a. LaSala Development Inc.; Block 139, Lot 46; Request for Release/Reduction of Performance Guarantees (Dkt. #466)
Kelly questioned who paid for the preparation of the report. The Township Utility Engineer
answered the Applicant.

Resolution shall be prepared for the February 10, 2005 Public Meeting.

2b. Amendment; Industrial Avenue Site Engineering Agreement
Roth questioned the timetable. The Township Utility Engineer’s Associate answered Tasks 1 and 2
are completed. Task 3 is in the process. The Report should be completed by the end of the month.

Resolution shall be prepared for the February 10, 2005 Public Meeting.

2c. Nilsen Avenue Booster Station Conceptual Design Report; Discussion
Carried.

2d. Bond Ordinance; Stage 5 Sanitary Sewer Project
The Business Administrator explained that this point the scope of the project has been defined. The
Township Attorney and Bond Counsel will prepare a Bond Ordinance. Suggestion was made for the
hearing to be a Special Meeting. And also, those who are not included in the Phase be notified.

Question was asked about the Township’s municipal contribution.

Roth questioned what the financial impact to the residents will be.

Paton requested a history of what was done in the past phases. The Business Administrator
explained Phase 1 had federal funds in 90% - assessment was $1,400.; Phase 2 – assessment was
$4,000.; Phase 3 – assessment was between $7,500 and $8,000. and in Phase 4 assessment was
between $8,000. and $9,000.

Municipal Clerk shall handle the sending of the Notices to those involved.

Paton requested the average assessment, the high assessment, the low assessment and the number of
participants in Phases 1, 2, 3 and 4.

Item carried to February 17, 2005 Work Session Meeting.

2e. Proposal; Consumer Confidence Report
Resolution shall be prepared for the February 10, 2005 Public Meeting.

2f. Progress Report
The Township Utility Engineer stated with regards to the 20” Water Main, Montana Construction
and the Bonding Company are still negotiating the terms of the Contract. The Township Utility
Engineer said he did not know when these negotiations would be finished.

The Township Attorney stated Council for the Bonding Company told him there is positive
movement on these negotiations, and the Contract had been sent to Montana Contracting’s Attorney
for review.

The Township Utility Engineer stated the Darlington Avenue Interconnection Record Drawings have
been submitted.

The Township Utility Engineer stated there are pictures available of the Fardale Demolition Tank for
Council’s perusal.

LEGAL
3a. Land Sale; Block 8, Lots 7, 8 and 9; Lakeview Drive
Item shall be discussed in Closed Session.

ADMINISTRATION
4a. Extension of State Contract #T-0109: Radio Communication Equipment and Accessories
Resolution shall be prepared for the February 10, 2005 Public Meeting.

4b. Shared Implementation Grant; Ramsey – Mahwah Vaughn Drive Sewer
The Business Administrator pointed out this will be at no cost to the Township to participate at
this time.

Resolution shall be prepared for the February 10, 2005 Public Meeting.

Calandrillo questioned the life of the communitors. The Business Administrator shall provide an
answer.

4d. Cancellation of 2004 Tax on Township Owned Properties
Resolution shall be prepared for the February 10, 2005 Public Meeting.

4e. Award of Bid #MTB-04-36: Solid Waste Collection
Alderisio questioned if it was ever explored to have 1 pick up in the winter and 2 in the summer.
The Business Administrator answered that he has spoken to the carter. The cost would not be
reduced.

Kelly questioned the manner which the garbage is picked up. In particular, Kelly referred to the
garbage truck backing up on the street in the opposite direction.

Administration recommended a 1 year contract.

Straw poll vote for 3 year contract: Alderisio, yes; Calandrillo, yes; DiGiulio, absent; Paton, yes;
Roth, yes; Richter, absent; Kelly, yes.

TOWNSHIP COUNCIL AND MUNICIPAL CLERK
5a. Confirmation of 2005 Fire Officers
Resolution shall be prepared for the February 10, 2005 Public Meeting.

5b. Acknowledgement; Township Access Transportation Program
Item carried.

5c. Resolution; Law of the Sea Treaty (Kelly)
Resolution shall be voted upon a the later portion of the meeting.

See Resolution #034-05, attached to and made part of these Meeting Minutes.

CLOSED SESSION
On a motion by Calandrillo, seconded by Roth, Council went into closed session at 10:26PM for the purposes of discussing Grievance; DPW Employee; Contract Negotiations; Blue Collar Union Contract; Monthly Litigation Report and Land Sale. All in favor. Motion carried.

On a motion by Paton, seconded by Roth, Council returned to open session at 11:45PM. All in favor. Motion carried.

On a motion by Paton, seconded by Roth, the meting was adjourned at 11:46PM. All in favor.
