MAHWAH HISTORIC PRESERVATION COMMISSION (MHPC)
April 14, 2005 MINUTES

The meeting was called to order at 7:35 p.m.

SUNSHINE STATEMENT: The secretary read the Sunshine Statement.

Minutes:
January 13, 2005 minutes: Mr. Vasiliadis made a motion to accept the minutes as read and Ms. Kennedy seconded the motion. The motion was approved.

PUBLIC SESSION:
Mr. Vasiliadis made a motion to open the Public Session and Ms. Kennedy seconded the motion. All approved.

The Public Session was opened at 7:45 p.m.

The Chair recognized Mr. Michael Spofera of T.S. Excavating. Mr. Spofera introduced himself as the builder for the owner of 4 Olney Road, and reported that Mrs. Sutter of 638 Summit Avenue, Franklin Lakes, NJ the daughter of the original owners came to the November 18, 2004 meeting requesting the HPC’s recommendation regarding the demolition of 4 Olney Road, and at that time, the HPC verbally approved of the demolition. The HPC did request permission to take photographs of the home and the owners approved. Mrs. Drago will arrange with Mr. Spofera a time and date to take the photographs.

Mr. Deke Schammilian, 14 Bogert Court, requested the Commission’s opinion on setting an escrow account for the remainder of the agreement to be fulfilled by Mr. Terhune of the Isaac Bogert estate. The Chair recommended that Mr. Schammilian call the Commission’s attorney to discuss the possibility of an escrow account. Mr. Schammilian agreed and thanked the Commission for their guidance.

Mr. Bristow made a motion to close the public session and Ms. Kennedy seconded the motion. All approved. The Public Session was closed at 8:00 p.m.

New Business:
Mrs. Drago reported that the Commission received a letter of resignation from Mr. Paul Gioni stating he could not make the commitment due to personal responsibilities. John Bristow regretfully made a motion to accept Mr. Gioni’s resignation and Mr. Vasiliadis seconded the motion. All approved.

Mrs. Drago introduced Ms. Lynn Ballarini, 184 Airmount Road, Mahwah, NJ, as a possible candidate for the vacancy created by Paul Gioni’s resignation. Mrs. Ballarini reported that she is a new resident of Mahwah, and very interested in working with the Commission. Mrs. Drago reported that the open position is a Mayoral appointment and that Ms. Ballarini should submit her resume to the Mayor and copy the Commission. The Commission thanked Ms. Ballarini for her interested and looks forward to hearing from her.

John Bristow motioned to recommend to the Mayor the appointment of Ms. Ballarini to the vacant Class C position created by the resignation of Mr. Paul Gioni and Mr. Vasiliadis seconded the motion. All approved.

Legal: No report at this time.

Street Names: The secretary reported that the Commission had received a request from the Sustack family to change the street name of Franklin Place to Sustack Place, since their home is the only house on the street. The secretary reported that the Police Department denied the request stating is was a personal name request. The OEM stated that it did not have a problem with changing the name, since the Township already has three streets using the name of Franklin. Mr. Vasiliadis motioned to deny the request stating it is not the policy of the Township to name street names using personal names. Family named streets are named after historically significant founding families or deceased Veterans of War. Ms. Kennedy seconded the motion.

Mr. Bristow motioned to table the issue of changing the street name of Franklin Place until the May 12, 2005 meeting, and Ms. Kennedy seconded the motion. All approved.

Applications:
The Estate of Howard MacPherson: 23 Olney Road, Docket 483, Minor Subdivision:
Mr. Cerullo motioned to approve Docket 483, with no comment and Ms. Kennedy seconded the motion. All approved.

Bristow, yes; Drago, yes.

Mr. Bristow reported that he believes that the bear caves that where built on the property by John Snow son of Elmer J. Snow, who was the first manager of the Brakeshoe factory, may still exist, and if so should not be destroyed, since it is part of the Mahwah folklore. Mr. Bristow will confirm the existence of the caves.

Mr. Cerullo motioned that if the caves still exist that the HPC send a recommendation to the Planning Board that the caves not be disturbed from any future developments and Mr. Vasiliadis seconded the motion. All approved.

John & Joan Remo, Docket 486: Minor subdivision. Mr. Vasiliadis motioned to approve Docket 486 with no comment and Ms. Kennedy seconded the motion. All approved.

Bogert Court, Single Family Home Site: Ms. Kennedy motioned to table this application until the May 12, 2005 meeting, giving Mr. Schammilian time to discuss his escrow proposal with the Commission attorney, and Mr. Bristow seconded the motion. All approved.

L. Moralita, Docket 417F: Final Major Subdivision. Mr. Bristow motioned to approve Docket 417F, with no comment and Ms. Kennedy seconded the motion. All approved.

Stag Hill Homes, Docket 485: Mr. Bristow motioned to approve Docket 417F, with no comment and Mr. Cerullo seconded the motion. All approved.

DEMOLITION:

4 Olney Road: Mr. Cerullo motioned to approve the demolition application of 4 Olney Road and Mr. Vasiliadis seconded the motion. All approved.
Mr. Bristow motioned to approve Docket 417F, with no comment and Ms. Kennedy seconded the motion. All approved.

Mr. Bristow motioned to adjourn the meeting and Mr. Vasiliadis seconded the motion.

The HPC meeting was adjourned at 9:15 p.m.
