HOUSING COMMISSION MEETING
TUESDAY, JUNE 15, 2004
The meeting was called to order at 8:00 PM by Chairman Dr. Bernard Ross, who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in the Ridgewood News on June 11, 2004 stating this meeting would be held in Room 311 in the Municipal Offices at 475 Corporate Drive, Mahwah, New Jersey on Tuesday, June 15, 2004 at 8:00 PM.
Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available from the Township Clerk, Secretary of the Housing Commission and the Municipal Web site upon adoption by the Commission.

Present: Commission members Brotherton, Martel (8:05) Raiz, Ross and Snyder
Absent: Commission members Calandrillo and Plicinski.
Also present Nilufer DeScherer, Associate Township Atty.
Brotherton made a motion, seconded by Snyder to accept the minutes of May 18, 2004 Housing Commission meeting. All in favor. Motion carried.
On a motion by Snyder, seconded by Raiz, the meeting was opened to the Public. All in favor. Motion carried.
No Public in attendance.
Raiz moved to close the Public Portion, seconded by Snyder. All in favor. Motion carried.
Brotherton made a motion to approve the Housing Commission meeting date schedule for 2004-2005. Raiz seconded. All in favor. Motion carried.
HOUSING MANAGER’S REPORTS
Reports were reviewed and discussed.
Ross asked DeScherer to check with COAH and determine if it’s possible as units are resold, if an amendment can be added to the present Ordinance stipulating a no rental policy. This would become an owner occupant restriction. DeScherer feels COAH would be in agreement with this suggestion.
a. Ridge Gardens:
1- 1411 Faulkner Ct. – Remaining Surplus Funds
2- 2107 Hawthorne Ln. – Remaining Surplus Funds
DeScherer will submit a request for the Township funds within the next month.
b. 1417 Faulkner Ct. – Violation- Court appearance scheduled for 6/22/04.
a. Letter to owners- Re: Refinance, etc.- Raiz discussed the possibility of a master letter going out to all unit owners for the purpose of reminding them of their obligation, should they wish to refinance, they must request the evaluated price from the Affordable Housing Dept.
Raiz made a motion to have DeScherer present a draft letter which will be sent to all owners, upon approval by the Commission, pertaining to the reevaluation of any loans and financing for the next Housing Commission meeting on July 20, 2004. Brotherton seconded. All in favor. Motion carried
b. Deed Language-Re: Municipal POA – DeScherer stated that as units are resold the new owners would execute a Power of Attorney to the Township in their Deeds which would allow the Twp. to a Right of Redemption if a Foreclosure should occur. She will prepare a draft for presentation at the next Housing Commission meeting.
Raiz asked DeScherer to follow up on the proposed form forwarded for her review regarding certification of funds in a Foreclosure case.
The next scheduled Housing Commission meeting is Tuesday, July 20, 2004 at 8:00 PM.
At 8:30 PM Raiz made a motion, seconded by Brotherton, to enter into Closed Session, for the purpose of discussing 1080 Ash Drive, 389 Poet’s Way and pending litigation.
At 8:40 PM Brotherton made a motion, seconded by Snyder, to return to Open Session. All in favor. Motion carried.
Snyder made a motion to authorize Twp. Counsel to enter into a Stipulation of Dismissal on 1080 Ash Dr. Raiz seconded. All in favor. Motion carried.
DeScherer will prepare the appropriate Resolution.
Being no further business, Brotherton made the motion for adjournment at 8:45 PM. Seconded by Raiz. All in favor. Motion carried.
