ENVIRONMENTAL COMMISSION

TOWNSHIP OF MAHWAH

APRIL 28, 2004



The meeting of the Environmental Commission was called to order at 7:40 p.m. by John Brotherton, Chairman. The Opening Statement was made. Roll call was taken.

MINUTES
The Minutes of the April 14, 2004 meeting were accepted as submitted.

ANJEC GRANT
The additional letter of support and Township Council Resolution of financial support for the grant application were sent to ANJEC. Susan Golz has not heard anything further from ANJEC.

DEP REGULATIONS
We received a memo from Brian Campion stating that the town would appreciate input of the Environmental Commission. Susan Golz is looking over the permit information.
It was felt the Commission needs to have these regulations explained by a Township professional.

SHADE TREES
We had a request from Stanley Spiech (DPW) for a recommendation for replacement street trees to replace Bradford pear trees damaged by wind during this winter.
We will advise him that the trees should be substituted with Capital or Chanticlear pear trees, due to the structural problems which developed with the Bradford variety.

Don Wenger asked if pruning or trimming would prevent the other existing trees from breaking. To our knowledge the DPW does not have a pruning or trimming program.

SITE PLAN REVIEW
Russo Development – John Brotherton reported that this application was denied at the Planning Board this week. We will retain landscaping plans from Gabrellian’s and Russo’s applications for comparison to any future submissions.

SOIL MOVEMENT PERMIT APPLICATIONS
Memo to Administrative Officer:
“The Environmental Commission reviewed the following soil permits at the meeting held on April 28, 2004. Comments are listed below.

The Swan Group, 14 Patrick Brem Ct., Bl. 21.09, Lot 4, E-BD-216-239-370 amended 4/12/04 – approved. The applicant is reminded that future street tree plantings by Darlington Associates should be kept under consideration when completing the landscaping plan.

Empire Development, LLC, 2 Patrick Brem Ct., Bl. 21.09, Lot 1, E-BD-216-239-372, dated 4/16/04. The application is approved. We note that thirty-three trees will be removed. Eight replacement trees will be planted using oak, birch and maple. Norway maple is not an acceptable variety for a replacement trees. (Also no white pines are to be used as replacement trees.) The applicant is reminded that future street tree plantings by Darlington Associates should be kept under consideration when completing the landscaping plan.

Fred Santainte, Jr., 37 Hampshire Road, Bl. 21.05, Lot 10, E-BD-216-304-341, dated 4/16/04 – approved.

John & Donna Conte, 656 Wyckoff Avenue, Bl. 159, Lot 10, E-BD-216-304-342, dated 4/19/04 – approved.

Sal Petruzzella, 5 High Street, Bl. 173, Lot 73-76 & 85-86, E-BD-216-1617, dated 4/20/04 – approved.

Vincent Cirillo, 43 Walsh Drive, Bl. 21.07, Lot 14, E-BD-216-304-344, dated 4/27/04.
We note there will be seven replacement trees. Please note that white pine is not an acceptable replacement variety. The application is approved.”

TENANT APPLICATION
A tenant application from Van Natta Mechanical Corp. at 25 Whitney Road was approved.


WATER ISSUES
We received handbook from ANJEC on Freshwater protection in NJ.

Earth Day Clean Up at Lake Henry Susan Golz expressed concern about removing too much dead wood in the area of Lake Henry and also, the possibility of some living trees near the shore line being removed. After a discussion, the following letter was written.
“To: Mayor and Council
Re: Environmental issues – Lake Henry

Some of us were involved in the Earth Day clean up on April 24th at Continental Soldiers Park, Lake Henry. We commend Mr. DaPuzzo for this project. We know that a lot of litter was collected and removed. We also noticed that some natural material was also being removed.

The Environmental Commission would like to be involved in all aspects of developing the natural area. We are concerned that over zealous clean up may destroy some areas of ecological importance. It is extremely important not to take down any trees along the shore line as they provide shade and temperature regulation required for the habitat of certain fish and freshwater species.

We look forward to being included in future planning.

The meeting was adjourned at 8: 55 p.m. The next meeting of the Environment Commission will be held on Wednesday, May 12, 2004 at 7:30 p.m. at the Municipal Building, 475 Corporate Drive, Mahwah, N.J.
