TOWNSHIP OF MAHWAH

HOUSING COMMISSION MEETING

Tuesday, September 17, 2002

Chairman, Dr. Bernard F. Ross, who read the Open Public Meetings Act Statement prescribed by law, called the meeting to order at 8:00 P.M. Notice of the meeting was published in the Ridgewood News on June 28, 2002, posted in the Township Hall and filed in the Township Clerk’s office.

Minutes of the meeting are available from the Township Clerk, the Secretary of the Housing Commission and the Municipal Web Site upon adoption by the Commission.

Present: Calandrillo, Martel (8:15), Plicinski, Ross, Snyder
D. Tamayne, Associate Twp. Atty.

Absent: Brotherton, Raiz

Calandrillo made a motion to approve the minutes of July 16, 2002 Housing Commission meeting. Plicinski seconded. Motion passed. Snyder abstained due to absence.

Public Portion

On a motion by Snyder, seconded by Calandrillo the meeting was opened for the Public Portion. Motion passed.

Julia Smith, 1201 Norfolk Road, represented the residents of Norfolk Village. The tenants feel the yearly rental increases are excessive and are requesting the support of the Housing Commission to petition Trenton for consideration of distinction on rental amendments pertaining to senior citizens.

Ross stated the Commission wrote a letter on their behalf to C.O.A.H. copying Federal and State Representatives. A reply was received from Maureen Fullaway, Executive Director stating any projects funded through Low Income Tax Credits (LITC), which Norfolk Village falls under, is not governed by COAH rules and are under federal guidelines.

In addition, a follow up meeting was held with Township representatives and
Norfolk Village residents, Smith and Schell, to discuss the response from Trenton and offered other options to pursue.

Tamayne explained it would be a conflict of interest for the Housing Commission to represent Norfolk Village. The Commission is charged with enforcing the COAH rules and regulations, a State mandated program, for Affordable Housing in the Township of Mahwah. However, the residents as a group can contact State and Federal Representatives. Also, contact other senior rental units throughout the State of New Jersey and make a joint effort to change legislation. The Commission will, as it has in the past, monitor the yearly increases, give guidance and support where allowed.

Snyder suggested the seniors gain access to a computer and find a senior chat room; inquire if others are upset with yearly rental increases. If so, organize a combined effort since there is always strength in numbers.

Smith was given a copy of the New Jersey Housing and Mortgage Finance Agency annual report which contains information on Low Income Tax Credits. She will report all suggestions to the residents for review and will also reach out to the Township Council.

Clandrillo made the motion to close the Public Portion. Plicinski seconded. Motion carried.

Correspondence

Bruce Whitaker, Esq. wrote a letter on behalf of his client, owner of 2010 Hawthorne Lane, requesting the $500.00 administrative fee be waived or reduced.

Martel made a motion for the regulations to be enforced, stating the Commission must abide by the existing policies and can not deviate from the rules. Calandrillo made the second.

Roll Call: Calandrillo-yes, Martel-yes, Plicinski-yes, Ross-yes, Snyder-yes.

Motion carried.

Housing Manager’s Reports

Report A – One unit listed for rent. Five are under sale pending and four have rentals pending.

Report B – Tamayne reported a settlement was reached with the owner of 735 Pepperidge Court.

Report C – No pending foreclosures at the present time.

Report D –Tamayne reported on the Motions filed for the recovery of surplus funds in Bergen County Superior Court for 1411 Faulkner Court and 2107 Hawthorne Lane.

Report E – Development Fees-current balance $448,372.86.

Unfinished Business

Norfolk Village – See Above.

New Business

Due to the League of Municipalities Convention and the Holiday season Calandrillo, made a motion to combine the November and December Housing Commission meetings. Plicinski seconded. Motion carried. The new date is Tuesday, December 3, 2002.

Being no further business Martel made the motion for adjournment at 9:15 P.M. Plicinski seconded. Motion carried. The next scheduled Housing Commission meeting is Tuesday, October 15, 2002.
