PUBLIC MEETING MINUTES
THURSDAY, AUGUST 22, 2002
This meeting immediately followed the Work Session Meeting and was called to order at 10:34PM by Council President Spiech.
Present: Councilmembers DaPuzzo, DiGiulio, Kelly, Paton, Richter and Spiech.
Absent: Councilwoman Calandrillo.
Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney’s Associate Donna Tamayne, Township Utility Engineer Justin Mahon, Township Utility Engineer’s Associate Vishal Shah and Municipal Clerk Kathrine Coletta.
APPROVAL OF BILLS AND CLAIMS
On a motion by Paton, seconded by Kelly, the Bills and Claims, previously signed, totaling $1,199,760.96, were approved. Roll call vote: Calandrillo, absent; DaPuzzo, yes; DiGiulio, yes; Kelly, yes; Paton, yes; Richter, yes; Spiech yes. A list of Bills and Claims is on file in the Municipal Clerk’s Office.
REPORT OF TOWNSHIP COUNCIL
DaPuzzo attended the Planning Board Meeting on August 12th. New member Merrie Ed Omsberg was sworn in. DaPuzzo referred to various actions taken by the Planning Board.
DaPuzzo attended the Youth Sports Boosters Meeting.
DaPuzzo asked if there are any plans to recognize Detective Captain Ray McGill’s retirement. Administration shall handle.
DiGiulio informed all of the Tree of Life planting to honor those who lost their lives on September 11, 2001. The dedication will be held on Old Station Lane across from Winters Pond on Wednesday, September 11, 2002 at 6:30PM.
DiGiulio has received many telephone calls from residents praising the Township’s Jr. Police Academy Program. DiGiulio thanked all of the officers involved.
DiGiulio thanked the Police Chief for cleaning up the police station property. The Police Chief is looking for help to replace one of the lights by the police station.
DiGiulio reported the Woman’s Club will not be having an Annual Fashion Show this year. The Woman’s Club was planning to hold a Bake Sale at the Stella Show’s Antique Fair but that has been cancelled.
Kelly attended the Senior Citizen’s Luncheon.
Kelly attended the Communications SubCommittee Meeting.
Kelly reported the Transportation SubCommittee will be holding a meeting in the near future.
Paton recently toured each of the Fire Companies in town with the Fire Chief.
Spiech attended the Senior Citizen’s Picnic.
Spiech has received several complaints about the helicopter landing at the Crossroads before 7:00AM.
REPORT OF THE MUNICIPAL CLERK
Certification of Supplementary Petition Results
Municipal Clerk, Kathrine Coletta, read a Certification of the Supplementary Petition Results which is attached to and made part of these meeting minutes.
The Township Attorney’s Associate explained the process for which the Township now proceeds.
On a motion by Richter, seconded by DaPuzzo, Ordinance #1422 shall be repealed. Yes vote is to rescind the Ordinance. No vote is not to rescind the Ordinance and to continue forward with the question going onto the November General Election ballot. Roll call vote: Calandrillo, absent; DaPuzzo, no; DiGiulio, no; Kelly, no; Paton, abstain; Richter, no; Spiech, no.
The Municipal Clerk shall notify the County Clerk of the question to be placed on the November 2002 General Election Ballot.
Richter thanked the Municipal Clerk for the many hours she spend on the petition.
Spiech thanked the Municipal Clerk for the job she did on the petition.
REPORT OF THE MAYOR AND BUSINESS ADMINISTRATOR
The Business Administrator reported the paving of Ridge Road has been completed.
GENERAL PUBLIC DISCUSSION
On a motion by Richter, seconded by Kelly, the meeting was opened to the public at 11:22PM. All in favor. Motion carried.
Mr. Howard Pierano of 179 Deerfield Terrace complained that with the water restrictions residents cannot wash their cars. Mr. Pierano questioned whether residents can use rain water. DaPuzzo interjected he contacted the DEP and residents cannot wash cars with water collected in large containers as it cannot be determined whether the water is tap water or water which fell from the sky.
Mr. Pierano complained he contacted the Police Department and when asked for a Police Officer he told one was not in the building. Administration shall handle.
Ms. Elaine Kownacki of 1518 Faulkner Court spoke on behalf of her mother, Mrs. Kownacki who resides at 35 Island Road. Ms. Kownacki read a letter into the record which expresses her mother’s concerns about the development on Mountain Avenue. Ms. Kownacki questioned what action she may take if she disagrees with the actions of the Planning Board. DaPuzzo answered he was at the Planning Board Meeting where the Planning Board Attorney advised Ms. Kownacki that she may appeal the decision of the Planning Board through the Superior Court in Hackensack. Ms. Kownacki questioned why her rights are not being protected by the Township.
Paton suggested the Township Attorney and the Planning Board Attorney together discuss this matter.
Spiech requested the Municipal Clerk contact the Planning Board Administrative Officer for any discussions, actions, etc. taken by the Planning Board on this matter.
On a motion by DiGiulio, seconded by Richter, the meeting was closed to the public at 11:53PM. All in favor. Motion carried.
Resolutions #070-02A, #075-02A, #076-02A and #086-02A were removed from the Agenda this evening and shall be considered at a future meeting.
Resolutions #071-02A through #074-02A, #077A-02A, #077B-02A, #078-02A through #085-02A, #087-02A through #090-02A were voted on under the Consent Agenda and are attached to and made part of these Meeting Minutes.
Approval of Raffle Applications
On a motion by DiGiulio, seconded by Richter, the Mahwah High School Thunderbird Sports Boosters Club Inc. (50/50) and Mahwah Schools Foundation (Wheel and Games) Raffle Applications were approved. Roll call vote: Calandrillo, absent; DaPuzzo, recused; DiGiulio, yes; Kelly, yes; Paton, yes; Richter, yes; Spiech, yes.
Resolution #091-02A was voted on and is attached to and made part of these Meeting Minutes.
On a motion by DiGiulio, seconded by Kelly, the meeting was opened to the public at 11:54PM. All in favor. Motion carried.
Being no comments were made from the public, on a motion by DiGiulio, seconded by Kelly, the meeting was closed to the public at 11:55PM. All in favor. Motion carried.
On a motion by DiGiulio, seconded by Richter, Council went into closed session at 11:56PM for the express purpose of discussing litigation with Viola Contracting Company. All in favor. Motion carried.
On a motion by Kelly, seconded by DaPuzzo, Council returned to open session at 12:09AM. All in favor. Motion carried.
REPORT OF SUBCOMMITTEES
Paton referred to the multiple page document on the Communications SubCommittee which he distributed to the Council. He requested this item be discussed at the next Work Session Meeting.
Spiech requested at the next Work Session Meeting the Grant Writer be discussed.
Spiech requested the Business administrator inquire if there is any money for GIS. The Business Administrator responded there is money to use.
Kelly reported the Transportation SubCommittee will be having a meeting next Monday.
On a motion by DaPuzzo, seconded by Kelly, the meeting was adjourned at 12:23AM. All in favor. Motion carried.
