TOWNSHIP OF MAHWAH
WORK SESSION MEETING MINUTES
THURSDAY, MARCH 21, 2002

The meeting was called to order at 8:00PM by Council President Spiech who read the Open Public Meetings Act Statement as prescribed by law. Notice was advertised in The Record on July 20, 2001 stating a combined Work Session/Public Meeting would be held in the Municipal Offices, 300B Route 17 South, Mahwah, New Jersey on Thursday, March 21, 2002 at 8:00PM.

Notice of this meeting is posted on the Municipal Bulletin Board. The minutes of this meeting shall be available in the Municipal Clerk’s Office.

Salute to the Flag.

Present: Councilmembers Calandrillo, DaPuzzo, Donigian, Richter and Spiech.
Absent: Councilmembers DiGiulio and Omsberg.

Also present were Mayor Richard J. Martel, Business Administrator Brian Campion, Township Attorney Menelaos Toskos, Township Engineer Kevin Boswell, Township Engineer Representative Michael Kelly, Township Utility Engineer Justin Mahon, Township Utility Engineer’s Associate Vishal Shah and Municipal Clerk Kathrine Coletta.


SUBMISSION OF BILLS AND CLAIMS
Bills and Claims will be voted on in the Public Meeting immediately following this meeting.

ENGINEERING (Boswell-McClave)
1a. Resurfacing of Ridge Road, Section 4; 2002 Local Aid Grant; Request for Authorization of Services
Calandrillo questioned whether the Police Chief is aware of the comment made in Township Engineer’s letter dated February 28, 2002 concerning the no left turn. The Township Engineer’s Representative shall contact the Police Chief for his comments.

The Business Administrator pointed out this item is only for the design portion of the bid.

Spiech questioned whether the services being provided include the curbs. The Township Engineer answered yes.

Resolution authorizing the professional engineering services of Boswell McClave Engineering at a cost not to exceed $8,000 for the resurfacing of Ridge Road (Section 4) - 2002 Local Aid Grant shall be voted on in the Public Meeting immediately following this meeting.

1b. Replacement of Curb and Sidewalk Below Train Trestle; East Ramapo Avenue; Recommendation of Award of Proposal
The Township Engineer’s Representative informed Council two quotes were received for the

sidewalk repair portion of the project. The Township Engineer’s Office is recommending the proposal be awarded to the lowest proposal: Tony’s Concrete Construction Company at a cost not to exceed $14,908.

The Business Administrator pointed out the sidewalk portion is part of the 2001 Sidewalk Program. The light will be a separate award that will be discussed at the April 4, 2002 Work Session Meeting.

Calandrillo questioned the cost of the lights and why New Jersey Transit is not installing the light. The Township Engineer’s Representative explained the representative of New Jersey Transit said New Jersey Transit is not interested in installing the light. They take no exception to the Township installing the light.

Resolution awarding the proposal for the repair of the curb and sidewalk below the train trestle on East Ramapo Avenue to Tony’s Concrete Construction Company at a cost not to exceed $14,908. will be voted on in the Public Meeting immediately following this meeting.

1c. Bike Path Program; Discussion
Carried; pending outcome of meeting with the New Jersey Department of Transportation.

1d. Verbal Status Report
Wyckoff Avenue and Forest Road Intersection Improvements: Richter questioned how long the work will be going on at the corner of Wyckoff Avenue and Forest Road. The Township Engineer’s Representative answered PSE&G is doing the work. The Township Engineer’s Representative will contact PSE&G on how long they anticipate being at the site. Richter is concerned because cars traveling on Wyckoff Avenue who do not want to wait in traffic cut through onto Franklin Street. The cars travel at a high rate of speed and Richter is concerned a child playing outside will be hit by a car. The Township Engineer’s Representative will contact the Police Department.

Airmont Avenue Recreation Facility/Update: the Township Engineer informed Council the plans on the layout and cost estimate will be distribute to the Council tomorrow and discussed at the April 4, 2002 Work Session Meeting. Spiech questioned if the project is still on budget. The Township Engineer answered the project is on budget as it pertains to what his Company was originally asked to complete.

UTILITY ENGINEER (Malcolm Pirnie)
2a. Proposal; Consumer Confidence Report
Spiech questioned the Utility Engineer as to whether the information required will be delivered to the Borough of Ramsey by April 1, 2002. The Township Utility Engineer answered he will do his

best to deliver the report by April 1, 2002. Spiech asked what will happen if the information is not received by the Borough of Ramsey by April 1, 2002. The Township Utility Engineer answered he is not aware of any monetary consequences. The Township Utility Engineer informed Council if he has the data by tomorrow he will have it to the Borough of Ramsey by April 1, 2002. Mayor Martel assured the Township Utility Engineer the Water Department will provide him with the necessary information.

Resolution awarding the contract for professional engineering services to Malcolm Pirnie Inc. relative to the development of the 2001 Consumer Confidence Report for the Township Water Department at a cost not to exceed $6,000. shall be voted on in the Public Meeting immediately following this meeting.

2b. Swim Club Water Line and Well Installation (Continuation of Discussion)
Council was provided with a quotation from Rinbrand Well Drilling Company.

This matter shall be carried for further discussion at the April 4, 2002 Work Session Meeting.

LEGAL
3a. Amendment; Chapter 4 of the Township Code (Limousines and Livery Service)
Ordinance will be introduced in the Public Meeting immediately following this meeting.

3b. Agreement; N.J.E.L.U. Local #1 Blue Collar Unit
Item will be discussed in Closed Session at the end of this meeting.

3c. Amendment to Site Plan Ordinance; Storm Water Specifications
Ordinance will be introduced in the Public Meeting immediately following this meeting.

3d. Agreement Between Township and County of Bergen; Intersection Improvements at Forest Road and Wyckoff Avenue
Carried to the April 4, 2002 Work Session Meeting.

ADMINISTRATION
4a. Amendment #2 to Resolution #031-01A; Special Counsel for Labor Disputes
Resolution shall be voted on in the Public Meeting immediately following this meeting.

4b. County Contract Award; Road Maintenance Materials
4c. County Contract Award; Diesel Fuel
4d. County Contract Award; Gasolines
Individual resolutions shall be voted on for the above three award of contracts at the Public Meeting immediately following this meeting.

4e. Emergency Temporary Appropriations
Resolution shall be voted on in the Public Meeting immediately following this meeting.

4f. Eagle Scout; Justin Ajamian; Boy Scout Troop #50
Resolution shall be voted on in the Public Meeting immediately following this meeting. Mayor’s Proclamation shall be read in the Public Meeting.

4g. Agreement with West Bergen Mental Healthcare; Voluntary Municipal Support of Mental Health Services and Employee Assistance Program
Resolution shall be voted on in the Public Meeting immediately following this meeting.

4h. Agreement with West Bergen Mental Healthcare; Child and Adolescent Substance Abuse and Mental Health Services
Resolution shall be voted on in the Public Meeting immediately following this meeting.

TOWNSHIP COUNCIL/MUNICIPAL CLERK
5a. Resolution Opposing Water Use Permit to Allow United Water New York to Withdraw Water from Potake Pond
Resolution shall be voted on in the Public Meeting immediately following this meeting.

5b. Raffle Application
Scandinavian American Heritage Society, Inc. (Off-Premise)
Raffle Application tentatively approved. Final approval shall be voted on in the Public Meeting immediately following this meeting.

5c. Resolution Urging the State Legislature to Oppose S-1044/A-1926, Which Would Legalize the Use of Project Labor Agreements in New Jersey
Resolution shall be voted on in the Public Meeting immediately following this meeting.

5d. Jr. Firefighter Application; Stephen Berger to Fire Company #4
Resolution shall be voted on in the Public Meeting immediately following this meeting.

COUNCIL COMMENTS/COMMUNICATIONS
DaPuzzo question whether the Township is planning to do a clean up around Earth Day. Donigian responded he was contacted by Trout Unlimited and they are interested in coming to the Township for a clean up on April 6, 2002. Richter interjected that at the Beautification Subcommittee Meeting a suggestion was made to do a clean up of different parts of town. No date has been determined. DaPuzzo again questioned whether the Township is looking to do anything for Earth Day. Suggestion was made to have a clean up on another day other than Earth Day. Date of April 20,

2002 was chosen. Donigian will coordinate with DaPuzzo. Site to be determined.

Spiech was asked by the Fire Department about grants. Richter will contact the Fire Chief.

CLOSED SESSION
On a motion by Calandrillo, seconded by DaPuzzo, Council went into closed session at 9:05PM for the purpose of discussing the Agreement between the Township and N.J.E.L.U. Local #1 Blue Collar Unit. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Spiech, Council returned to open session at 9:19PM. All in favor. Motion carried.

On a motion by Calandrillo, seconded by Spiech, the Work Session was adjourned at 9:20PM. Council proceeded to the Public Meeting. All in favor. Motion carried.
